text: About three years ago two shopkeepers, Musalmans residing in the plains, received Rs.300 from the Sema Nagas promising to purchase for them an elephant. But the men used the money for their own purposes and purchased no elephant. The Nagas having been put off from time to time with promises of payment, were at last obliged to bring a criminal complaint against one of the two Musalmans, the other having in the meantime died. The court, considering all the circumstances of the case, fined the accused Rs.310 under section 403, Indian Penal Code, and ordered the whole of the fine to be paid to the complainant Nagas as compensation. A sum of Rs.100 out of this has been realised and paid to the Nagas. The balance is under realisation.
