at a court here held 31.5.1637 Edw Clarke and Wm Brand were admitted tenants of the lord for themselves and their heirs by the surrender of Jane Clench widow late wife of Hen Clench deceased and afterwards wife of Jn Elliston gentleman and now deceased to one customary messuage lately built and 20a of land more or less called Sandhills upon the consideration and with this intention that the aforesaid Edw Clarke and Wm Brand should make such surrenders and legal assurances concerning the premises and to such persons or person as Rich Harlakenden esq lord of the aforesaid manor and brother of the said Jane should limit and nominate as by a roll of the aforesaid court it appears now to this court came the aforesaid Edw Clarke and Wm Brand and produced here in court a certain document under the hand and seal of the said Rich Harlakenden signed and sealed bearing the date 2.10. which same said script the aforesaid Rich Harlakenden present in court acknowledged by which the aforesaid Rich Harlakenden wished and ordered the aforesaid Edw and Wm to surrender the aforesaid premises amongst other things to the use of Jane Clench and Helen Clench daughters of the said Jane Elliston and the heirs of their bodies legitimately procreated and in default of such issue to the use of the heirs of the body of the said Jane Elliston in full satisfaction and completion of the separate bequests or gifts made to the said Jane and Helen in or by the last will of the said Hen Clench their father and in default of such issue to the use of the rightful heirs of the said Jane Elliston forever and upon this the aforesaid Edw Clarke and Wm Brand in full and open court surrendered into the hands of the lord by the hands of the aforesaid steward the aforesaid messuage and 20a of land more or less with appurtenances to the use and behoof of the said Jane and Helen and the heirs of their bodies legitimately procreated and in default of such issue to the use of the heirs of the body of the said Jane Elliston legitimately procreated in satisfaction and completion of the bequests and aforesaid gifts and in default of such issue to the use of the rightful heirs of the said Jane Elliston forever to whom the same said Jane Clench and Helen Clench by the hands of Robt Crow their deputy in this part the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have and to hold the aforesaid messuage and other premises with appurtenances to the aforesaid Jane Clench and Helen Clench and the heirs of their bodies legitimately procreated the remainder thereof in the aforesaid form from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and they gave to the lord for a fine etc
