admission of Edw Abbutt | at this court it was testified by the steward and was shown by the homage that Jn Morly gentleman customary tenant of this manor and Mary his wife Mary herself first solely and secretly examined by the aforesaid steward and agreeing as is the custom surrendered by the rod into the hands of he lord by the hands of his steward all that parcel of land called Priestland and Dagnall Hill containing by estimation 24a more or less situated in Earls Colne to the use and behoof of Edw Abbott of Earls Colne aforesaid linen draper his heirs and assigns forever upon the following condition viz that if the aforesaid Jn or Mary or either of them their heirs executors administrators or assigns or either of them should pay or cause to be paid to the aforesaid Edw his executors administrators or assigns the sum of 116li12s in or upon 2.5.1675 at the dwelling house of the aforesaid Edw situated in Earls Colne aforesaid that then the aforesaid surrender should be void now at this court came the aforesaid Edw Abbott and gave to the court intelligence and information that the aforesaid sum or any part of it thereof was not paid at the time before mentioned and at this time remained unpaid and he humbly sought from the lord admittance for himself to the premises as tenant to whom the lord by his steward granted and delivered seisin thereof by the rod to have and to hold the aforesaid lands with appurtenances to the aforesaid Edw Abbott his heirs and assigns from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents and services thereunto belonging and by right accustomed and he gave to the lord for a fine etc |
