also at this court found that on 30.3.1744 Thos Brewster surrendered by the hands of Rich Wale gentleman instead of the bailiff in the presence of Jn Harrington and Sam Smith gentleman all that his tenement and garden and rentary adjoining with appurtenances called Ruffles and one piece of land containing 2r late parcel of Barnhaws situate in Earls Colne in the several tenures of the said Thos Brewster Robt Hull Thos Fell and Eliz Catley or their assigns and the reversion etc to the use of Ann Holgate of Earls Colne widow her heirs and assigns forever upon condition that if the said Thos Brewster his heirs etc should pay unto the said Ann Holgate her executors etc the sum of 40li with legal interest at or upon 30.9.next then this surrender to be void etc
