who say upon their oath that Sam Brewer customary tenant of this same manor after the last court and out of court surrendered into the hands of the lord by the hands of Simon Ive instead of the bailiff in the presence of Jeff Potter and Dan Lea two customary tenants of this same manor according to the custom of this manor all that capital messuage with garden and curtilage adjoining sometime called Sonningwells and also one tenement adjoining called Tabors with all their appurtenances lying in the said Earls Colne which he had by the surrender of Jn Knight as shown at a court here held 20.9.1608 to the use of Jn Potter senior of Earls Colne yeoman his heirs and assigns forever and now at this court the lord by his said steward granted to the same Jn Potter by Jn Hawkesbie clerk attorney for the said Jn Potter in his part legitimately constituted seisin of the premises to hold from the lord by the rod at the will of the lord according to the custom of the said manor by the services thereunto belonging and by right and he gave to the lord his fine and fealty was respited and afterwards this same day out of court the said Jn Potter surrendered into the hands of the lord of the said manor by the hands of Jn Parker instead of the bailiff in the presence of Thos Pryor and Robt Crowe two customary tenants of the same manor according to the custom of the said manor all and singular the said premises with appurtenances to the use of Jn Potter himself for and during his natural lifetime and after his decease then to the use of Jeff Potter his brother and Ann his wife for the term of their lifetimes and to the longer liver upon condition and as long as that the said Jeff and Ann or either of them or their assigns or any of them should pay or either of them should pay or cause to be paid to Joan Brewer wife of Sam Brewer or her assigns annually and each year during the natural lifetime of Joan 10 0s twice a year namely at the feast of michaelmas and at the annunciation at or in the said capital messuage called Sonningwells by equal portions and after the decease of the said Jeff and Ann then to the use of Jn Potter son of Wm Potter brother of the said Jn and his heirs if and as long as the said Jn Potter the son of the said Wm should pay or cause to be paid or his heirs executors or assigns should pay or cause to be paid to the aforesaid Joan or her assigns during the natural lifetime of the said Joan annually and each year the full sum of 100s at the said two terms at the feast of michaelmas and the annunciation in equal parts at or in the said dwelling house called Sonningwells or if it should happen that the said Jeff and Ann or either of them after the death of the said Jn Potter senior should make default in paying the said 100s to the aforesaid Joan Brewer yearly during her lifetime contrary to the said form or the said Jn Potter son of the said Wm Potter or the heirs of the said Jn the son after the death of the said Jeff and Ann should make default in paying the said 100s to the aforesaid Joan during her lifetime contrary to the said form then and immediately after such default or defaults all and singular the said premises with appurtenances with rights and remainders should go to the said Joan and her heirs forever
