at a court here held 3.1.1668 Jn Fletcher and Mary his wife were admitted tenants to them and the heirs of their bodies legitimately procreated to remain to the right heirs of the said Jn to 5a of land more or less with appurtenances situate in Earls Colne now at this court came Geo Toller in person and by licence of the lord etc complained against the said Jn Fletcher and Mary his wife in a plea of land viz in 5a of land with appurtenances in Earls Colne within the jurisdiction of this court held of the manor aforesaid by copy etc into which the said Jn and Mary do not have ingress since the disseisin which Hugh Hunt unjustly made from the said Geo within thirty years last past and the said Geo made protest to prosecute his suit in the form and nature of a writ of the lord kin of ingress sur disseisin in le post at the common law according to the custom of the manor and brought pledge to prosecute Jn Doe and Rich Roe and petitioned process according to the custom etc to the said Jn Fletcher and Mary by the bailiff to be directed to be here at this court before the steward this 28.12. at the hour of nine am to reply to the said Geo in the plea aforesaid and the said Jn and Mary present here in court in person freely appeared etc and the said Geo complained against them as aforesaid etc upon which the said Jn Fletcher and Mary came and defended their right etc and called to warranty Jn Finch who present in court in person freely warranted the said lands to them etc and upon this the said Geo petitioned against Jn Finch etc and the said Jn defended his right and said that the said Hugh Hunt did not disseise the said Geo of the tenements etc in manner and form supposed by the said Geo etc and put himself on the homage of the court and the said Geo petitioned licence to implead until the hour of ten am and it was granted and at the said hour the same Geo appeared but Jn Finch though solemnly warned failed to appear but made default etc upon which consideration the said Geo recovered against the said Jn Fletcher and Mary his wife seisin of the said lands etc and precept to the bailiff to be directed to make him seisin of the said lands in the form of a recovery and it was granted at the house of eleven am at which time Jn Wendon bailiff and minister of the court delivered seisin to him etc and he was admitted etc and fine pardoned etc and afterwards in the same court came the said Geo Toller and surrendered the said 5a of land with appurtenances as recovered into the hands of the lord to the use of the said Jn Fletcher and Mary his wife and their heirs and assigns forever which said Jn Fletcher and Mary here petition admittance to whom the steward delivered seisin to have and to hold the lands aforesaid to the said Jn and Mary their heirs and assigns forever of the lord etc and the fine was pardoned
