at a court held 3.1.1678 Jn Fletcher and Mary his wife were admitted to themselves and the heirs of their bodies legitimately procreated and in default of such issue to the rightful heirs of the said Jn and Mary to one messuage and one garden from ancient times Wm Green and about 4a of enclosed land lying next to Hynds Land in Earls Colne now at this court it is shown by the homage that the said Jn Fletcher and Mary his wife surrendered on 19.3.1679 by Geo Toller gentleman instead of the bailiff in the presence of Jn Garrett gentleman and Jn Finch all that messuage or tenement and garden adjoining and about 4a of land lying next to Hynds Land with appurtenances in Earls Colne now in the occupation of Jn Fletcher or his assigns and the reversion and reversions remainder and remainders thereof and all the estates rights titles interests proclaimed and claimed by the said Jn Fletcher and Mary his wife of and in the same or any of the parcels to the practice use and interest and under the provisions and conditions concerning the said messuage or tenement and garden and appurtenances to Jn Fletcher and Mary his wife during their natural life and to the longer liver and after their decease to Jn Fletcher junior during his natural life and after his death to Rosamund Harris if the intended marriage between herself and the said Jn Fletcher junior is celebrated for the term of her natural life and after the death of both of them to the heirs of the body of the said Jn Fletcher junior and Rosamund legitimately procreated and in default of such issue to the rightful heirs of the said Jn Fletcher junior forever and also as far as the said 4a of land plus appurtenances to the use of the said Jn Fletcher junior for the term of his natural life and after his death to Rosamund Harris during her natural life and after the death of both of them to the heirs of the body of the said Jn Fletcher junior and Rosamund legitimately procreated and in default of such issue to the heirs of Jn Fletcher junior forever proviso always on this express condition that the said Jn Fletcher junior and Rosamund Harris or either of them or the heirs of the said Jn Fletcher junior within five years of the death of Jn Fletcher senior and Mary his wife do and well and faithfully pay or cause to be paid to Ruth Fletcher younger daughter of the said Jn Fletcher and Mary his wife the sum of 50li and if it should happen that Ruth Fletcher dies before the 50li is paid then the said 50li should be equally divided between Grace Fletcher Ann Fletcher and Rose Fletcher the three other daughters of Jn Fletcher senior and Mary his wife at the same time as it was to be paid to Ruth Fletcher provided also and on this other condition that if the said Rosamund Harris when she reaches twenty one years or at any time afterwards should refuse or neglect to grant and to confirm by a good and sufficient legal deed or bond all her goods or estates already realised as personal which the said Rosamund only possesses to the use of the said Jn Fletcher junior and heirs which then stand to the separate use of the said limitation of the said Rosamund after such a refusal her personal property will be to the use of the said Jn Fletcher junior his heirs and assigns forever and afterwards the said Jn Fletcher junior humbly seeks admittance to the said 4a of land and appurtenances according to the provisions and conditions above and he pays his fine for admittance etc
