and also appeared to homage and was attested by steward that 11.3.last past Thos Mayhew of Bardfield Magna in Essex and Sarah his wife who was the daughter of Jn Edwin a customary tenant of the manor surrendered into hand of lord by hand of steward she Sarah first secretly and solely examined by steward and consenting according to custom of manor a customary messuage or tenement with appurtenances situate in Earls Colne in tenure of Jn Marven and Jacob Rayner or assigns to use of Jacob Alen of Bumpsted in county of Essex yeoman and Jn Fitch of Stoke near Clare in county of Suffolk yeoman their heirs and assigns subject only and under condition in said surrender mentioned and expressed to wit upon condition nevertheless that if the said Thos Mayhew do and shall yearly and every year during the coverture between him and the said Sarah his wife well and truly pay to her the said Sarah his wife unto her proper hands the interest and proceeds of the sum of 100li part of the trust money mentioned in one indenture bearing date 2.2.last past made between the said Thos Mayhew and Sarah his wife of the one part and the said Jas Alen and the said Jn Fitch of the other part to be by them paid to said Thos Mayhew subject to the payment mentioned in this condition and also that if the said Sarah the wife of the said Thos Mayhew shall survive and outlive the said Thos Mayhew her husband and shall have issue by him then living then if the executors or administrators of the said Thos Mayhew do and shall well and truly pay yearly and every year during the term of the natural life of the said Sarah the wife of said Thos Mayhew unto her the said Sarah or her assigns the legal interest and proceed of the said sum of 100li always upon the second day of february in every year also if there happen to be no issue of the said Thos Mayhew and Sarah his wife living at the time of the decease of the said Thos Mayhew and that the said Sarah his wife shall survive and outlive him the said Thos Mayhew her said husband that then and in such case if the heirs executors or administrators of the said Thos Mayhew do and shall within three months next after the decease of the said Thos Mayhew well and truly pay or cause to be paid unto the said Sarah the wife of the said Thos Mayhew her executors administrators or assigns the said sum of 100li principal money with what interest money shall then be due for the same or otherwise from time to time cause and procure good legal and sufficient discharge to be given and delivered unto them the said Jas Allen and Jn Fitch and the survivor of them and the executors and administrators of the survivor of them not only for the yearly interest of the said sum of 100li as the same shall become due and payable but also for the said sum of 100li principal money in case the same shall become payable to the said Sarah the wife of the said Thos Mayhew so as the said Jas Allen and the said Jn Fitch and the survivor of them and the executors and administrators of the survivor of them shall and may from time to time at all times hereafter be fully clearly and absolutely acquitted exonerated and discharged of and from any other or further payment or payments to be at any time made of the said sum of 100li and the yearly interest and proceed thereof to her the said Sarah the wife of the said Thos Mayhew or her assigns by them the said Jas Allen or Jn Fitch or the survivor of them or the executors or administrators of the survivor of them and likewise be saved kept harmless and indemnified against all suits troubles costs charges and damages whatsoever touching or anyways relating to the same in any respect howsoever then the surrender shall be void or else to be in full force
