and whereas there is now due and owing to Martha Hart widow and administratrix of Thos Hart deceased on the said security the sum of 12li7s5d1h by reason whereof the premises are in law become absolutely vested in Martha Hart aged 8yr and Eliz Hart aged about 5yr daughters and heirs of Thos Hart whereupon come into court said Martha and Eliz and humbly crave etc admitted tenants to premises etc as heirs in common and not joint heirs etc annual rent 5d# in trust nevertheless for Martha Hart her executors administrators and assigns and immediately after admission etc came into court Mark Poulter and Eliz his wife Edw Rayner Jos Brown and Kath his wife Thos Lawrence and Ann his wife Thos Jones and Hannah his wife said Eliz Poulter Kath Brown Ann Lawrence and Hannah Jones being first solely and secretly examined by steward and consenting as is custom in open court surrendered and released in consideration of sum of 7li to them paid by said Martha Hart widow and administratrix of Thos Hart deceased into hands of lords by hands and acceptance of steward the said messuage with appurtenances and all their right title interest property claim and demand whatever both in law and equity of and in said messuage and appurtenances with buildings yards gardens and orchards belonging to use of Martha Hart and Eliz Hart daughters of Thos Hart and Martha his wife their heirs and assigns as tenants in common and not as joint tenants forever in trust as aforesaid
