in the name of god amen the 17.5.1568 I Robt Upchar of Much Tey of the county of Essex and the diocese of London yeoman being sick in body but of whole and perfect remembrance thanks be unto almighty god do make and ordain this my testament containing my last will in manner and form following first I bequeath my soul unto the mercy of almighty god and my body to be buried in the parish church of Much Tey aforesaid near unto my parents item I give unto the poor men's box of Much Tey aforesaid 13s4d and to the poor people of Chappel parish 6s8d item I give and bequeath unto Agnes my wife all that my messuage wherein I now dwell with all the houses barns stables yards orchards gardens lands meadows and pastures and hereditaments called or known by the name or names of Abrahams Kippings Brookhouse and Coggshalls and those my tenements and lands with the appurtenances called Dormaches Fordlands and Bagges Acre and all those my lands tenements and hereditaments with whatsoever as well free as copy by whatever name or names soever they be known reputed or called lying and being at Much Tey and Earls Colne in the said county of Essex as they be now in my own hands and occupation except the tenement and lands called Baldwins and all such other lands as well free as copy late demised and granted in farm unto one Hen Somersom and which late were in the occupation of the said Hen Somersom as of his assigns to have and to hold all the said messuage lands tenements and other the premises with the appurtenances except before excepted unto the said Agnes my wife during her natural life upon condition that the said Agnes and her assigns shall keep and maintain the said messuage house and buildings and all other the premises in good and sufficient reparation and shall do no waste in and upon the said lands and other the premises and also shall not challenge or claim any third or dower in any the rest of my said lands and after the decease of the said Agnes my wife I will all the said messuages lands and tenements and other the premises and appurtenances as well free as copy shall wholly remain unto Jn my son and to his heirs forever item I give and bequeath unto the said Jn my son all that my said tenement and lands called the Baldwins and all such other my lands as well free as copy as late were in the tenure and occupation of the same Hen Somersom to have and to hold unto the said Jn my son and his heirs forever from and after his age of twenty one years and in the mean season to remain in the hands of the said Agnes my wife item I give and bequeath unto the said Jn my son all those my free lands and tenements called Flemmings lying in Pontisbright otherwise Chappel parish now in the tenure and occupation of one Crosse upon condition that he the said Jn shall pay out of the said lands called Flemming 20li of good and lawful money of England to Robt my son at the age of twenty one years of the said Robt or within three months next after his said age to have and to hold the said lands called Flemmings unto the said Jn my son and to his heirs forever upon condition aforesaid from and after his said age of twenty one years and in the mean season to remain in the hands of my said wife provided that if the said Jn my son shall not pay unto the said Robt my son the said 20li in manner aforesaid that then I will the said Robt my son shall have and enjoy the said lands called Flemminge to him and to his heirs forever any thing herein to the contrary in anywise notwithstanding item I give and bequeath unto the said Robt my son all those my messuages lands and tenements meadows pastures and hereditaments in Withermonford alias Wormingford in the said county of Essex now in the tenure and occupation of Wm Browne gent or of his assigns and all others those my lands tenements hereditaments in Wormingford aforesaid to have and to hold to the said Robt my son and to his heirs forever from and after his age of twenty one years and in the mean season to remain in the hands of the said Agnes my wife item I give unto the said Robt my son a certain parcel of land Little Flemminges holden by copy of court roll in Chappel parish aforesaid to have and to hold unto the said Robt my son and to his heirs according to the custom of the manor whereof it is holden item I give and bequeath unto Joan my daughter 40li of lawful money of England to be paid by the said Agnes my wife or the executors of her unto the said Joan at her age of twenty one years or day of marriage which first shall happen and if the said Joan my daughter shall happen to depart this world before said age or day of marriage that then I will the said part shall be given unto my said sons or to the survivors of them item I give and bequeath unto the said Jn and Robt my sons either of them 6li13s4d of lawful money of England to be paid to them on their several age or ages of twenty four years and if any of them depart this world before their said age that then the survivor of them shall have his part item I give unto Margt Colman my sister 20s and to Jn Colman her son and Alice her daughter to either of them 13s4d to be paid within one year next after my decease provided and it is my said will that if it shall happen that the said Agnes my wife to marry after my decease that I will he that shall fortune to marry with her shall before his marriage with two sufficient sureties with him stand bound unto my supervisor hereunder named in one obligation of 200li sufficient in the law as well for the payment of all the legacies and houses in good and sufficient reparations from time during the said life of the said Agnes and also shall do no waste in and upon any said lands to her before assigned and that he shall refuse this to do or that she do marry before this be done or shall claim any third in the rest of my lands that then I will the said Jn my son shall enter upon all the said lands and tenements to her before bequeathed and she to stand only to her third any thing herein to the contrary in anywise notwithstanding item I give unto the said Jn my son my maser bound with silver and to the said Robt my son my silver piece and the rest of my goods debts plate money cattle whatsoever they be I do wholly give and bequeath unto the said Agnes my wife in consideration that she shall find and bring up my children pay all my debts pay and discharge all my legacies and perform this my testament and to see my body decently brought to earth which said Agnes I do ordain and make my executrix of this my said testament also I do name and appoint my well beloved friend Wm Vigorus of Halsted supervisor of this my said testament to see it performed accordingly to whom I give 20s and all his necessary costs and expenses these being
