in the name of god amen the 13.2.1622 I Sam Diglett of White Colne in the county of Essex miller being sick in body but yet in good and perfect remembrance I do thank god therefore do declare and make this my last will and testament in manner and form following first and principally I surrender and bequeath my soul into the hands of almighty god my only saviour and redeemer by whose precious bloodshedding upon the cross I do steadfastly hope to have remission of all my sins my body to the earth from whence it was taken to be decently buried according to my degree item I do give and bequeath all my reversion or remainder of in and to all that customary land called Wentland and all my right title and interest in and to the same land unto my brother Jn Diglett to have and to hold the same reversion or remainder and all my right title and interest in and to the same land to the said Jn Diglett and his heirs upon condition that the said Jn Diglett his heirs or assigns shall pay or cause to be paid to Kath now my wife or her assigns within six months next after the decease of Eliz Longley widow my mother at or in the south porch of the parish church of White Colne abovesaid the sum of 40li of lawful money of England which I will shall be paid to her or her assigns so as upon the payment thereof she do release surrender and give up to my said brother Jn Diglett and his heirs all her estate right title and interest in and to the same land and likewise upon condition that the said Jn Diglett his heirs or assigns shall pay unto Jn Diglett my eldest son the sum of 18li of lawful money of England at the place aforesaid within three months next after the end of the said six months and likewise upon condition that the said Jn Diglett my brother his heirs or assigns do pay unto Ann my daughter the wife of Thos Smith or her assigns at the place aforesaid 7li of lawful money of England within one year next after the decease of the said Eliz my mother and likewise upon condition that the said Jn Diglett my brother or his assigns shall pay unto Sam Diglett my son 10li of lawful money of England at the place aforesaid within two years next after the decease of the said Eliz my mother and likewise upon condition that the said Jn Diglett my brother his heirs or assigns shall pay unto Jane my daughter 5li of like money at the place aforesaid within three months next after the end of the said two years and if my said son Sam or my said daughter Jane shall fortune to die before such time as they are to receive the money to them to be paid as aforesaid then my will and meaning is that the money by this my will to be paid to either of them so dying shall be and remain to the survivor of them and if both of them shall fortune to die before such time as they are to receive the money to them to be paid as aforesaid then my will and meaning is that the money by this my will to be paid to either of them so dying shall be and remain to my said son Jn and my said daughter Ann to be equally divided between them item I do give unto my said daughter Jane my least brass pot and I do give unto the said Kath my wife all the rest and residue of my goods and chattels whatsoever whom I do ordain and make sole executor of this my last will and testament in witness whereof I have hereunto put my hand and seal the day and year above written sealed subscribed and published as his last will and testament in the presence of Rich Sydeye Simon Ive Sam Diglett
