in the name of god amen I Geo Warren of Ridgwell in the county of Essex yeoman being of sound mind and memory do make and appoint this my last will and testament as followeth first I commend my soul into the hands of almighty god hoping for a joyful resurrection through the alone merits of my blessed saviour jesus christ and my body to be buried at the discretion of my executor herein after named and my worldly estate I dispose as followeth imprimis I give and bequeath unto Susan my loving wife my two closes of land and pasture called Drivers containing by estimation 11a or less part whereof is copy and part freehold with the barn and all and singular their appurtenances lying and being in Ridgwell aforesaid to hold the same during the term of her natural life according to an indenture and surrender made to her upon marriage and after the decease of my said wife I give and bequeath the said two closes of land and pasture and the said barn and appurtenances unto Deborah Rogers my daughter the wife of Joseph Rogers for and during the term of her natural life and after her decease to Geo Rogers my grandchild and his heirs forever upon condition that if Joseph Rogers my son in law Deborah his wife Geo Rogers my grandchild or some or one of them shall not pay or cause to be paid unto my said loving wife Susan her executors or assigns the sum of 100li within six months next after my decease with interest for the same after the rate of 6li percent from the day of my death then my will is that my said wife Susan shall have the said two closes of land and pasture with the barns and appurtenances to her heirs forever according to an indenture and surrender upon marriage with my said wife item I give and bequeath unto Susan my said wife for and during the term of her natural life all that my copyhold tenement with the appurtenances called Bruses situate in Ridgwell aforesaid and after her decease I give and bequeath the same to Ann Shippy my daughter and her heirs in case Wm Shippy her husband shall happen to be then dead but if the said Wm Shippy her husband shall happen to be living at the time of the death of my said wife then I bequeath the same to my friends Rich Piper and Hen Chaplin of Ridgwell aforesaid and their heirs upon trust and confidence in them reposed that they permit and suffer the said Ann Shippy my daughter and her assigns during the life of the said Wm Shippey to receive and take the rents issues and profits thereof for her own sole and separate maintenance and upon further confidence that the said Hen Chaplin and Rich Piper and their heirs and assigns reposed that after the decease of the said Wm Shippy they or the survivor of them their executors or administrators shall surrender and convey the said tenement with the appurtenances to the use and behoof of the said Ann Shippey or to the use of such person or persons or to such trust intention uses or purposes as the said Ann Shippy shall by any deed or writing by her in the presence of two or more credible witnesses signed sealed limit declare and appoint and my will is that the said Rich Piper and Hen Chaplin shall be at no charge in or about the execution of the trust aforesaid item I give unto Joseph Rogers my son in law and to Deborah Rogers my daughter wife of the said Joseph all that my freehold messuage called Newhouse with all the barns stables outhouses yards gardens orchards and all their appurtenances with 5a of pasture thereto adjoining called Pannells Croft and also two closes of freehold land and pasture called Tomlins containing by estimation 18a more or less all which said messuage and lands I lately purchased of Thos Huppup of Linton tanner and are now in the occupation of Jon Wyatt and Thos Wybrow or their assigns for and during the term of their natural lives and the life of the longer liver of them and after their decease I give and bequeath the same to Joseph Rogers my grandchild and his heirs upon condition that if Joseph Rogers my son in law Deborah Rogers my daughter or Joseph Rogers my grandchild their heirs or assigns do pay unto Ann Shippy my daughter the sum of 100li of lawful money of England within one month after my decease in case the said Wm Shippy her husband shall be then dead but in case the said Wm shall be then living then my will and meaning is that the said 100li shall be paid unto my loving friends Rich Piper and Hen Chaplin aforesaid up on trust and confidence that they or the survivor of them their executors administrators or assigns shall during the life of the said Wm Shippy from time to time quarterly pay unto the said Ann Shippy all the interest and profit of the said 100li as the same shall become due and upon further trust and confidence in them reposed that the said Rich Piper and Hen Chaplin or the survivor of them or their executors administrators or assigns shall deliver up the said 100li or other security concerning the same unto the said Ann Shippy or her assigns immediately after the death of the said Wm Shippy her husband but if the said Joseph Rogers my son in law Deborah my daughter or Joseph Rogers my grandson their heirs or assigns shall neglect or refuse to pay the said sum of 100li at the times aforesaid to my said trustees or my said daughter as aforementioned then my will and meaning is that my said trustees or my daughter Ann their executors or assigns into all and every part of the said freehold messuage lands tenements and premises shall enter and the same have hold possess and enjoy and receive the rents issues and profits thereof until the said sum of 100li with all interest damages and charges of the same shall be fully satisfied and paid and my will is that my said trustees shall be at no charges about the execution of the said trust also my will is that my said son in law Joseph Rogers my son in law (sic) Deborah his wife or Joseph Rogers my grandchild their heirs or assigns shall pay out of the said messuages lands and premises last mentioned to them devised as aforesaid the several sums of money following in manner hereinafter appointed to the several persons herein after named viz to my grandchild Edm Warren the sum of 10li at his age of 21yr to my three grandchildren Rachel Sarah and Dorcas Warren 10li apiece of lawful money of England when they shall attain their respective ages of 18yr and my will and meaning is that if any of my said grandchildren last named shall happen to depart this life before they shall attain their several ages of 18yr that then the part or legacy of such child or children shall be equally divided between my surviving children in this my bequest named but if Jas Fromantell or Rachel Warren his daughter or the said Edm Rachel Sarah or Dorcas Warren my said grandchildren or any other person by or from them shall at any time after my decease claim or demand any rent pretended due to them or any of them for the house and tenement I now dwell in called Jordans for any time during my life or put my executor to any trouble or charge about the same then my will is that my said grandchildren Edm Rachel Sarah and Dorcas Warren shall not have any part of the said 10li apiece so bequeathed unto them as aforesaid item I give and bequeath unto my grandchildren Mary Sarah and Ann Copsey the sum of 4li apiece to be paid to them at their several ages of 16yr and if any of them die before the said age of 16yr then my will is that the part of such child or children shall be paid to the survivor or survivors of them at the said age out of the messuage lands and tenements last mentioned item I give and bequeath to Ann Shippy my daughter 10li worth of household stuff she to elect which she shall please after my decease and appraisal of the same for her own sole use and benefit item I give unto my said wife 40s in money and all her wearing apparel 2bush of wheat and 2bush of malt and half a load of wood and all such goods as I agreed upon marriage to leave her item I give and bequeath to Agnes Newman my daughter all that my tenement or cottage in Earls Colne wherein she now liveth during her life and after her decease to Ann Newman my grandchild and her heirs but for want of her issue then I give the same to my next heir item I give to my daughter Dorcas Saffold 1s item I give unto my grandchild Sam Choate 5li to be paid at my said grandchild's age of 20yr item to my grandchild Sam Saffold 20s to be paid at his age of 21yr and I do will all my said legacies to be paid out of my real as well as my personal estate given to my executor hereinafter named and charge all my lands so given for the payment of the same item I do nominate and appoint my said son in law Joseph Rogers sole executor of this my last will and testament
