this is the last will and testament of me Wm Gardener of Earls Colne in the county of Essex I nominate constitute and appoint Jn Taylor the younger of Earls Colne aforesaid surgeon and Wm Walter Good of Braiswick House Lexden in the said county executors and trustees of this my will I direst that all my just debts funeral and testamentary expenses be duly paid and satisfied by my said executors as soon as conveniently may be after my decease I give and devise all my freehold messuage or tenement situate in Earls Colne aforesaid with the stable orchard yard garden and appurtenances to the same belonging now in the tenure or occupation of Wm Smith unto my daughter Harriet Ann her heirs and assigns for ever I likewise authorise my said executors to sell or mortgage immediately after my decease the above named property for the purpose of paying my funeral expenses and for the future maintenance of my daughter Harriet Ann Gardener and their signatures shall be sufficient to make good the title of the said property I give and devise (subject to the charges which may affect the same at the time of my decease) all that my freehold messuage or tenement with the malting yard gardens and appurtenances thereto belonging situated in Earls Colne aforesaid and now in the occupation of Wm Pilgrim unto my said daughter her assigns and heirs for ever and also the rents and profits of my said freehold messuages or tenements for the sole use and benefit of my said daughter until she shall attain the age of twenty-one years however should it be thought proper by the aforesaid executors to hold and retain the said malt office house and appurtenances after my said daughter has attained the age of twenty-one years I give them full power to hold or sell the same as they may think fit and lastly I revoke all former wills by me at any time heretofore made and declare this to be my last will and testament in witness whereof I the said Wm Gardener the testator to this my last will and testament have set my hand the 8.7.1851 in the presence of the two credible witnesses whose names are hereunto subscribed Wm Gardener memorandum the foregoing writing was signed by the said Wm Gardener at the foot or end thereof and acknowledged by him to be his last will and testament in the presence of us who were present at the same time and we do hereby at his request attest and subscribe our names as witnesses to the said will in his presence and in the presence of each other accordingly Joseph Good W.
