whereas at a court here held 28.12.1638 Edm Coxe and Ann Gray widow were admitted tenants of the lord for themselves and their heirs to one croft of land with enclosed garden upon which croft a messuage was lately built commonly called Mallorys and to two crofts of land lying between Mills Fenn and the brook containing 5a of land more or less and to two crofts of land whereof one lies next to Sandhill and contains by estimation 4a of land and the other croft late parcel of Mills Fenn lies between the said croft of land and the king's highway leading towards Tey Magna with appurtenances by the surrender of Jn Kent Geo Bentall and Ann his wife upon the condition that if the aforesaid Jn Kent Geo Bentall and Ann his wife or any of them their heirs executors or assigns should pay to the aforesaid Edm Coxe and Ann Gray or their assigns 10li of legal money of England yearly for a term of ten years from 22.12. to be paid fully in or upon the feast of the nativity st jn bapt and xmas or within two days after the aforesaid feast by equal portions and 150li upon the feast of xmas.1648 together with the 5li which then would be owing from the aforesaid annual sum of 10li that t hen the aforesaid surrender would be void as by a roll of the aforesaid court it appears and whereas after the said court and before this court the aforesaid Geo Bentall died now to this court came the aforesaid Edm Coxe and Ann Gray and by the agreement and election of the said Jn Kent and Ann Bentall present in court and by and in consideration of the 150li16s8d paid to the aforesaid Edm and Ann Gray in court by Ralph Josselyn of Earls Colne clerk in full court surrendered into the hands of the lord by the hands of his aforesaid steward the aforesaid messuage croft and enclosed garden and all and singular the premises with appurtenances to the use and behoof of the said Ralph Josselyn his heirs and assigns who present in court humbly sought admittance to the premises to whom the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have and to hold the aforesaid messuage and all and singular the premises with appurtenances to the aforesaid Ralph Josselyn his heirs and assigns from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and he made fine and fealty etc and afterwards in this same court and the court sitting came the aforesaid Jn Kent and Ann Bentall and by and in consideration of 70li of legal money of England paid to the aforesaid Jn and Ann by the aforesaid Ralph Josselyn in full and open court surrendered into the hands of the lord by the hands of the aforesaid steward the aforesaid messuage and all and singular the premises with appurtenances to the use and behoof of the said Ralph and his heirs and by licence of the lord for themselves and their heirs relaxed remitted and quitclaimed to the aforesaid Ralph Josselyne and his heirs all right title claim condition interest and their demands or any of them in and to the aforesaid messuage and other premises with appurtenances and for such a release the aforesaid Ralph gave to the lord for a fine
