Nich Jekyll and Martha his wife to a messuage and 1r of land | whereas at a court held for the said manor 2.11.1653 Edm Brewer clerk who held to him and his heirs one messuage with the appurtenances in Castle Hedingham and 1r of land more or less lying between a croft of land called Brasiers and a certain garden late of the right honourable the earl of Oxford did in open court surrender into the hands of the lord of the said manor by the hands of his steward the said messuage and 1r of land with the appurtenances by the name of all his customary messuage lands and tenements held of the said manor to the uses intents and purposes in his last will and testament to be mentioned and declared and whereas at a court held for the said manor 5.1.1659 it was presented by the homage that the said Edm since the then last court died of the said premises so seised but because after proclamation thrice made according to the custom of the said manor none came to be admitted tenant of the said premises a precept was made to the bailiff of the said manor to seize the same into the lord's hands etc now at this court came Nich Jekyll gentleman and showed forth in court the last will and testament of the said Edm Brewer bearing the date 14.8.1658 wherein and whereby the said Edm did will and devise some part of his lands and tenements to Mary his wife for her lifetime with remainders over and as concerning the said messuage and 1r of land and all the residue of his said land and tenements the said Edm did by his said will and testament will and devise as follows item I will and devise that all my lands and tenements not herein before bequeathed shall be sold by my executors or the survivor of them within a convenient time after my decease and the money thereof arising I will shall go towards the payment of my debts and the residue thereof to remain in my said wife's hand for and towards the maintenance and education of my three daughters Lucy Ruth and Hannah until their several ages of twenty one years or days of marriage which shall first happen and then to be severally and respectively paid unto them or the survivors of them and did make the said Mary his wife and Sidrach Smith his executors of the said will and by the said last will and testament it doth and may more fully appear and the said Nich Jekyll did further show forth in court a certain deed indented bearing date 9.4.1659 made between the said Mary and Sidrach of the one part and the said Nich Jekyll and Martha his wife on the other part in and by which indenture the said Mary and Sidrach by virtue of the power to them given by the said will did in consideration of 860li of lawful english money to them paid or secured to be paid by the said Nich did bargain and sell the said first mentioned messuage and 1r of land with the appurtenances amongst other things to the said Nich Jekyll and Martha his said wife and to the heirs and assigns of the said Nich forever as by the said recited indenture it doth and may more at large appear and thereupon the said Nich did desire that he the said Nich and the said Martha may be admitted tenants of the said messuage and 1r of land with the appurtenances to which said Nich in his own person and to the said Martha by the hands of the said Nich as her deputy in that behalf the lord of the said manor by his said steward hath granted and delivered thereof seisin by the rod to have and to hold the said messuage and 1r of land more or less with the appurtenances to the said Nich and Martha and to the heirs and assigns of the said Nich forever of the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs due and of right accustomed and the said Nich gave the lord for his own fine 9li and for the fine of the said Martha 3li and so they were admitted tenants |
