admission of Jane Josselin | whereas at a court here held 28.12.1674 Jn Fletcher and Mary his wife were admitted for themselves and their heirs to one garden upon which a barn was lately built now taken down sometime of Barth Church and to one parcel of land called Loveland also Loveneys containing by estimation 10a more or less in Earls Colne and also to one piece of land called Inhams lying next to Burrough Bridge situated in Earls Colne and whereas at a court here held 11.12.1677 it was shown by the then homage that the aforesaid Jn Fletcher and Mary his wife the aforesaid Mary first solely and secretly examined by the aforesaid steward and consenting as is the custom surrendered by the rod into the hands of the lord of the aforesaid manor by the hands of his aforesaid steward the aforesaid garden and aforesaid parcel of land with appurtenances to the use and behoof of Jane Josselin wife of Ralph Josselin of Earls Colne clerk for and during the term of her natural lifetime and after her decease to the use of such person or persons as such people and heirs as the aforesaid Ralph Josselin should name and appoint by a writing under his hand and seal and in default of such appointments and limitations to the use and behoof of Rebecca Josselin one of the daughters of the aforesaid Ralph and the aforesaid heirs of the aforesaid Rebecca forever upon the following condition namely that if the aforesaid Jn Fletcher and Mary his wife or any of their heirs executors administrators or assigns or any of them should well and truly pay or cause to be paid to the aforesaid Ralph Josselin his executors administrators or assigns the full sum of 106li in the following manner and form viz 3li as a parcel thereof upon 30.6.1677 and 103li as the rest of the aforesaid 106li upon 31.12.1677 that then the aforesaid surrender should be void now to this court came the aforesaid Ralph Josselin and gave intelligence to the court that the aforesaid sum was not paid on the day for the aforesaid payment nor any part thereof but the aforesaid sum to this time remains unpaid upon which the aforesaid Jane Josselin by the aforesaid Ralph Josselin her husband and her attorney or deputy in this part humbly sought from the lord admittance to all and singular the aforesaid premises for herself to whom by her aforesaid attorney or deputy the lord by his steward granted and delivered seisin thereof by the rod to have and to hold the aforesaid parcel of land and all and singular the aforesaid premises to the aforesaid Jane Josselin and her assigns for and during the term of her natural lifetime the remainder thereof as limited in the aforesaid surrender from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and she gave to the lord for a fine etc |
