at this court it appeared that Eliz Toller of Earls Colne widow customary tenant of the manor came before the deputy steward 2.5.1716 and surrendered a messuage and garden adjoining called Oldhall one garden called Sagis Garden one other garden called Judsgarden and a parcel of garden containing in length 6rod and in breadth 4rod lying between a garden called Pruds on one part and lands belonging to Colne Priory on the other part and one parcel of land belonging to St Mary Croft and containing in length 18rod2ft of assize to the east and 1rod 2ft to the west which said messuage garden and premises then were in the tenure or occupation of Thos Piper or his assigns as shown by copy of court roll and the reversion etc to the several uses herein mentioned viz to the use of Eliz Toller and her heirs until a marriage is celebrated between Jn Bell of Witham Essex linen draper and Thomasine Toller spinster youngest daughter of the said Eliz and after the solemnisation to the use of the said Eliz for the term of her life and after her decease to the use of Thomasine and her assigns for her life and after her death to the use of the said Jn Bell and his assigns for his life and after their deaths to the use of the heirs of the bodies of the said Jn Bell and Thomasine between them legitimately procreated according to the uses in the will of the said Eliz nominated and for defect of such nomination to the use of the heirs of the bodies of Jn Bell and Thomasine etc and for defect of issue to the use of the right heirs of the said Thomasine forever
