to this court came Jn Farthyng and Eliz his wife Eliz herself solely and secretly examined by the steward and acknowledging surrendered into the hands of the lord one customary cottage with garden adjoining with appurtenances called Boxsteds as by the metes and bounds etc to the use and behoof of Margt wife of Cornelius Harman and Jasper Harman son of the said Cornelius and the heirs of Jasper himself who present in court came and sought admittance thereof and they were admitted thereof tenants of the lord to whom by the steward the lord delivered thereof seisin to hold for themselves and the heirs of Jasper himself from the lord by the rod at the will of the lord according to the custom of the manor etc and they gave to the lord their fine as is shown in the margin
6s8d and the said Jasper made fealty to the lord however this same present surrender and seisin thereof freely made is upon the following condition viz that if the said Margt and Jasper or either of them or their rightful attorneys or heirs should pay or cause to be paid to the aforesaid Jn Farthing or his rightful attorney or executors in the dwelling house of Jn himself at Colne within a bond of 7li13s4d sterling and a further 40s remaining to be paid in the following manner and form viz at the feast of michaelmas next following upon the title of this court in the aforesaid place 13s4d and on feast of michaelmas then next following in the said place 33s4d and on the feast of michaelmas then next following in the said place 33s4d and on feast of michaelmas then next following in the same said place 33s4d and on the feast of michaelmas then next following in the said place 40s in full payment of the 7li13s4d that then the present surrender and free seisin thereof should stand in all its force and remain in effect and if there should be default in any of the said payments against the said form that then it should be the right of the same said Jn Farthyng and Eliz his wife and their heirs to reenter and retake the said cottage with garden adjoining with appurtenances called Boxsteds and any parcel thereof and thus as they hold and enjoy and possess thus in their peaceful estate and the aforesaid Margt and Jasper and the heirs and assigns of the said Jasper should be expelled and removed from the present and surrender and free seisin thereof and non of it should stand
