whereas at a court here held friday being 7.10.1608 Thos Pearetree was admitted tenant of the lord for himself and his heirs to one tenement or cottage now new built upon one small parcel of pasture parcel of Rushefield with yards and gardens adjoining the said tenement as it is now enclosed and divided from the rest of the said parcel of land called Rushefield at the north west corner of the said pasture as in the said court it was shown now at this court it is shown by the homage that the said Thos Pearetree out of this court and after the last court surrendered the said cottage and other premises with appurtenances into the hands of the lord by the hands of Simon Ive instead of the bailiff in the presence of Thos Smithe and Jas Pennock customary tenants of this manor the same testifying according to the custom of the said manor to the use and behoof of Jn Abbotte blacksmith and his heirs upon condition that if the said Thos Pearetree his heirs executors or assigns should pay or cause to be paid to the aforesaid Jn Abbotte his heirs executors or assigns the sum of 22li upon the 24.10.1611 at or in the said dwelling house of Jn Abbotte situated in the said Colne Wake then the said surrender should be completely void and with no force in law otherwise it should remain in all its authority as effected
