the homage present that before this Clem Connie late customary tenant of this manor died who before his death surrendered into the hands of the lord by the hands of Simon Ive instead of the bailiff in the presence of Jn Pierson and Thos Smyth two customary tenants of the said manor the same testifying according to the custom of the said manor all his customary tenements with appurtenances called Coopes and all other houses and tenements held of the said manor to the use and performance of his last will by which last will here in court produced and shown proved under the signature of the official bearing the date 12.1.1619 it is shown that the said Clem Cunnie gave and bequeathed among other things all that customary tenement with appurtenances called Coopes to the use and behoof of Hen Cunnie son of the said Clem and his heirs forever the tenor of which same last will concerning the premises in the following english words item I give unto Hen Connie my son all that my copyhold tenement with appurtenances called Coopes holden of the manor of Earls Colne except the house and yard now in the occupation of Thos Pilgrime to have and to hold to the said Hen and to his heirs forever from and after the decease of Dorcas now my wife upon condition that the said Hen his heirs or assigns do pay or cause to be paid to Lucy Cunnie my daughter the sum of 5li within two years next after the decease of the said Dorcas my wife and to Jn Cunnie my son the like sum of 5li within two years next after that the said Lucy Cunnie ought by this my last will and testament to receive the said sum of 5li at or in the south porch of the parish church of Earls Colne aforesaid that is to say 50s each year during the term of four years until the several sums of 5li be fully satisfied and paid to the said Lucy and Jn and if the said Hen his heirs or assigns shall make default of payment of the said several sums of 5li in manner and form aforesaid then I will that the said Lucy and Jn or such of them to whom default of payment shall be made of the several sums aforesaid shall enter upon the said tenement with appurtenances and shall have and enjoy the same tenement with appurtenances before by me given to the said Hen and his heirs until they shall be fully satisfied and paid the said several sums of 5li out of the issues and profits of the same now at this court it is shown by the homage that after the last court and before this court the aforesaid Dorcas died upon which to this said court came the said Hen Cunnie and humbly sought from the lord admittance to the said tenement called Coopes with appurtenances according to the tenor and effect of the said last will to whom the lord by his said steward granted seisin thereof to hold to himself and his heirs according to the effect stated in the last will from the lord by the rod at the will of the lord according to the custom of the said manor by the rents and services thereunto belonging and by right accustomed and he gave to the lord his fine and made fealty and was admitted thereof tenant of the lord
