and furthermore it is shown by the homage that Thos Prior paid Jn Furley gentleman 46li according to the effective conditions mentioned in the court roll bearing the date bearing the date 26.12.1640 and upon the same came into open court the said Thos Prior and Mary his wife in person and Mary herself solely and secretly examined by the steward of the court as is the custom and surrendered into the hands of the lord by the hands of the said steward one customary messuage and garden with appurtenances called Cloviers to the use and behoof of Jas Nicholls yeoman his heirs and assigns forever upon the condition that if the said Thos Prior and Mary or either of them their heirs executors or assigns or any of them pay or cause to be paid to the said Jas Nicholls his executors or assigns 52li in or upon the 26.12.1643 at or in the mansion house of the said Jas situated in Earls Colne that then the said surrender will be void
