whereas at a court here held 27.12.1641 Thos Prior and Mary his wife customary tenants of the said manor in right of Mary herself in full court Mary herself solely and secretly examined by the steward of the court as is the custom surrendered into the hands of the lord by the hands of his steward one messuage and garden with appurtenances called Cloviers which the said Mary took for herself and her heirs at a court here held 23.4.1622 to the use and behoof of Jas Nicols of Earls Colne yeoman his heirs and assigns upon the condition that if the said Thos and Mary or either of them their heirs executors or assigns pay or cause to be paid to the said Jas his executors or assigns 52li of legal english money upon 26.12.1643 at the mansion house of the said Jas in Earls Colne that then the said surrender would be void as is clearly shown by the said court roll now to this court came the said Jas Nicols and gave to the court the information that the said 52li was not paid according to the said condition and to this date he was unpaid which the said Thos present in court confessed upon which the said Jas Nicols humbly sought admittance to the premises to whom the lord by the said steward granted and delivered seisin by the rod to have the said messuage and garden with appurtenances to the said Jas Nicols his heirs and assigns from the lord by the rod at the will of the lord according to the customs of the said manor by the rents services and customs thereunto belonging and by right accustomed and he gave to the lord his fine and made fealty
