whereas at a court held for the said manor 3.11.1657 Robt Abbott after a recovery had was admitted tenant to him and his heirs to three crofts of land called Husseys containing 4a more or less late parcel of a tenement and 30a of land called Crudes and to 1a2r of meadow more or less lying in two parcels or pieces and lying under the lord's park and to 2r of meadow more or less late parcel of 2a of land lying under the park called Colne Park between certain lands called Chewnislands towards the south and a meadow late of Wm Fisher parcel of The Hayhouse towards the north one head thereof abutting upon a common meadow of the lord's tenants towards the east and the other head thereof abutting upon a meadow late of Rich Smith alias Orbel towards the west and to one croft of land containing by estimation 1r more or less with the appurtenances now at this court it was presented by the homage that since the last court that is to say upon 21.1.1658 the said Robt Abbott did according to the custom of the said manor surrender into the hands of the lord of the said manor by the hands of the said Jn Joscelyne steward by patent of the said manor the said three crofts of land called Husseys the said 1a2r of meadow the said 2r of meadow the said croft of land with the appurtenances by the name of all his customary lands tenements and hereditaments held of the said manor together with all his lands tenements and hereditaments held of the manor of Colne Priory to the use of Hen Abbott brother of the said Robt and of his assigns for and during the term of the natural life of the said Hen and from and after the decease of the said Hen to the use of Thomasine Abbott daughter of the said Hen and of her heirs and assigns forever upon the trust and upon the conditions herein after mentioned that is to say upon trust that the said Hen and Thomasine and the heirs and assigns of the said Thomasine some or one of them in case the said Robt shall happen to depart this life without heir of his body lawfully begotten shall and do pay or cause to be paid to Edw Abbott brother of the said Hen and Robt 100li of good and lawful English money at or in the now dwelling house of the said Hen situate in Earls Colne within one year after the decease of the said Robt if the said Edw be then living provided always and upon condition that the said Hen and Thomasine and the heirs and assigns of the said Thomasine shall permit and suffer the said Robt at any time within three years next ensuing the date of the said surrender with cart carriages or otherwise to come and be upon the said premises or any part thereof and to hew cut down take and carry away ten trees there growing upon the premises at the election of the said Robt and then to dispose at his will and pleasure and upon this further condition that the said Hen and Thomasine and the heirs of the said Thomasine some or one of them shall well and truly pay or cause to be paid to the said Robt yearly and every year during the term of the natural life of the said Robt at or in the said then dwelling house of the said Hen 20li of good and lawful English money upon every twenty fifth of march and twenty ninth day of september or within twenty days after the said respective days of payment aforesaid the moiety of taxes deducted and upon this further condition that if the said Robt shall happen to have any heir of his body lawfully begotten and living at the time of his death or that shall be born alive after his death that then the said surrender to be void and of none effect and thereupon the said Hen Abbott being present in court desired to be admitted tenant of the said three crofts of land called Husseys to whom the lord of the said manor by his said steward did grant and deliver thereof seisin by the rod to have and to hold the said three crofts of land with the appurtenances to the said Hen and his assigns for and during the term of his natural life upon the trust and conditions aforementioned of the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs due etc and he gave to the lord for his fine and the said Hen did desire to be admitted tenant of the said 1a2r of meadow more or less with the appurtenances lying in two parcels or pieces to whom the lord of the said manor by his said steward did grant and deliver thereof seisin by the rod to have and to hold the said 1a2r of meadow more of less with the appurtenances to the said Hen and his assigns for and during the term of his natural life upon the trust and condition aforementioned of the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs due and he gave to the lord for a fine
