at a court here held 16.10.1673 Robt Finch was admitted to him and his heirs to one cottage of tenement with a garden adjoining called Charles Payne between Earls Colne churchyard on one part to the north and the way leading to Colne Park to the south one head abuts on the church green to the east and the other head on The Hallyard to the west and also to one shop called The Forge adjoining the said cottage with appurtenances now at this court it appeared to the homage that the said Robt Finch died after the last court and that before his death on 9.1.last he surrendered into the hands of the lord by the hands of Rich Fisher instead of the bailiff in the presence of Ralph Josselin clerk and Humph Ruggles two customary tenants etc the said tenement and shop and all and singular the premises to the use of Robt Finch junior nephew of the said Robt and his heirs and assigns forever on the condition following that Sam Finch brother of the said Robt senior is to take the rents of all the premises during the natural life of Ann Finch mother of the said Robt senior and to pay the aforesaid rents annually every year during the life of the said Ann the sum of 3li in equal portions at the usual quarter days the first payment to be made at the next quarter day after his decease and that the said Ann Finch to have convenient habitation in the aforesaid messuage and the use of the well and yard there for her life and the residue of the rents aforesaid to keep or sell for a portion and use of the said Robt Finch junior and to pay the fine for the said Robt junior and the stock so coming to the use of the use and benefit of the said Robt Finch junior and if the said Ann dies before the said Robt Finch junior reaches the age of twenty four years then the said Sam to dispose of the premises and the rents and profits thereof to the use of the said Robt Finch junior upon which the said Robt Finch junior present in court humbly petitioned admittance etc to whom the steward delivered seisin to have and to hold the said tenement and shop etc to the said Robt Finch junior his heirs and assigns according to the form and effect of the condition aforesaid of the lord etc and he gave the lord for fine etc
