at a court held 8.10.1678 Nich Kendall was admitted to one messuage with an orchard called Barretts alias Mihills now at this court it appeared that on 4.2.last he surrendered by the hands of Sam Carter instead of the bailiff in the presence of Jn Newton and Jn Bullock all his customary lands held of the manor to the use of his last will and the said Nich died after the last court upon which came into court Mary Kendall his daughter and showed the will dated 15.2.1690 the tenor concerning the premises as follows item I give and bequeath unto Mary Kendall my daughter and to her heirs and assigns forever all that my copyhold messuage or tenement with the yards gardens orchards and appurtenances to the same belonging situate and being in Earls Colne aforesaid and held of the said manor by copy of court roll item I give and bequeath unto my loving wife Mary all the aforesaid messuage or tenement with appurtenances if the said Mary Kendall my daughter shall happen to depart this life without issue of her body lawfully begotten and the said Mary was admitted to have to her according to the intentions in the last will etc and gave fine and fealty respited
