to this court comes Jn Poulter of Clare in county of Suffolk gentleman and produces here in court a certain charter of indenture dated 13.7.1716 under hand and seal of Hen Abbutt a customary tenant of this manor purporting to be a letting or demising among others of customary land and tenement of said Hen held of this manor by copy of court roll to Jn Poulter and therefore pleads leave of the lord that said charter be entered in court roll and lord of said manor freely should confirm said demising according to tenor therein and it was granted that the said entry should be confirmed by will of the lords from time to time until the end of the demising of the demised customary tenement or any part or parcel of it entering the seisure separately from other licences or concessions paying fines amercements or other debts and services before entry made for said premises or all and full intentions and propositions of this present licence or confirmation of entry into rolls would not be granted etc which demising is in following english words viz this indenture made 10.7.1716 etc between Hen Abbutt of Earls Colne in the county of Essex gentleman of the one part and Jn Poulter of Clare in the county of Suffolk gentleman on the other part whereas the said Hen Abbutt is now and standeth now lawfully seised of and in all that messuage and tenement and farm called or known by the name of Hayhouse or otherwise together with all the free and copyhold lands meadows pastures hopgrounds hereditaments and appurtenances thereunto belonging situate lying and being in Earls Colne aforesaid and now in the occupation of the said Hen Abbutt or his assigns and also of and in all that messuage or tenement with the malting office houses outhouses buildings yards gardens orchards and two crofts or parcels of lands thereunto belonging called Morces Tenement or by whatsoever name or names the same is called or known containing in the whole by estimation 3a more or less situate lying and being in Earls Colne aforesaid and now also in the occupation of the said Hen Abbutt his assignee or assigns and also of and in all that freehold messuage tenement and farm together with all meadows lands pastures woods woodgrounds hereditaments and appurtenances thereunto belonging or in any wise appertaining called or known by the name of Lucas Reading or otherwise containing together by estimation 40a more or less and also all that wood or woodground commonly called or known by the name of the Freizes or otherwise containing by estimation about 4a situate lying and being in Stisteed and Halsteed or in one of them in the said county of Essex and also all those freehold messuages lands pastures woods woodgrounds tenements and hereditaments with their appurtenances situate lying and being in Stisteed and Halsteed aforesaid or in one of them formerly belonging to Hen Alston Sam Alston Math Alston Dan Alston and Martha his wife or to some or one of them and afterwards the same did belong to Jn Wilbore of whom or his trustees or mortgagees Hen Abbutt deceased late grandfather of the said Hen Abbutt party to these presents did formerly purchase the same all said farms lands and premises were formerly in the occupation of said Hen Abbutt deceased and Math Pitchfork and now are in the several occupations of said Hen Abbutt party to these presents and Steph Girnon or one of them their or one of their assignees or assigns and whereas the said Hen Abbutt is and standeth indebted unto the said Jn Poulter in the full and just sum of 620li which said sum of 620li the said Hen Abbutt is not able presently to pay and discharge and yet minding and faithfully intending to satisfy and pay the same as soon as conveniently he may or can now this indenture witnesseth that the said Hen Abbutt to the end and intent that the said sum of 620li may be fully satisfied and paid to the said Jn Poulter his executors administrators and assigns and also in consideration of the sum of 5s of lawful money of Great Britain with him in hand paid by the said Jn Poulter at or before the sealing and delivery of these presents and for divers other good causes and considerations him the said Hen Abbutt hereunto moving hath demised granted and to farm letten and by these presents doth demise grant and to farm let unto the said Jn Poulter his executors administrators and assigns all these the aforesaid messuages lands tenements meadows pastures woods woodgrounds hereditaments and premises whatsoever to the said messuages or tenements belonging or in anywise appertaining or therewith usually held occupied or enjoyed and also all other the messuages farms lands meadows pastures woodgrounds hereditaments and premises whatsoever of him the said Hen Abbutt situate lying and being in Earls Colne Stisteed and Halsteed aforesaid or in any other parish or place there near adjoining now in the several tenures or occupations of said Hen Abbutt party to these presents and Steph Girnon or one of them their or one of their assignee or assigns and the reversion and reversions remainder and remainders of all and singular the said premises and all rents and yearly profits reserved and made payable in or by any lease or leases made or granted or to be made or granted on the said premises hereby granted or any of them to have and to hold the said messuages farm houses lands meadows pastures woods woodgrounds hereditaments and all and singular other the premises and all and every part and parcel thereof and every of their appurtenances hereby demised or mentioned to be demised unto the said Jn Poulter his executors administrators or assigns from the day of the date of these presents for and during and until the end and term of one and twenty years from thence next ensuing and fully to be complete and ended without impeachment of and for any manner of waste yielding and paying therefore yearly and every year during the said term unto the said Hen Abbutt his heirs or assigns the yearly rent of one peppercorn if lawfully demanded yet nevertheless upon this special trust and considerance in the said Jn Poulter his executors administrators and assigns by him the said Hen Abbutt reposed and to the end and intent that the said Jn Poulter his executors administrators and assigns shall and may of and from the clear yearly rent and profits arising out of from or by the said messuages lands tenements meadows pastures woods woodgrounds hereditaments and premises with their appurtenances pay satisfy and discharge himself the said sum of 620li provided always and it is hereby intended declared and agreed that it shall and may be lawful to and for the said Jn Poulter his executors administrators and assigns from time to time and at all times during the said term to deduct and abate out of the yearly rents issues and profits of the said premises such taxes which shall be imposed on the same premises by virtue of any act or acts of parliament and also such sum and sums of money as shall at any time or times during the said term be extended or laid out in and about the repairing of the said premises or any part thereof and also all such sum or sums of money charges and expenses whatsoever that the said Jn Poulter his executors administrators or assigns shall at any time during the said term expend lay out or any ways be put to by means thereof and the said Jn Poulter for himself his executors administrators or assigns doth covenant promise and agree to and with the said Hen Abbutt his executors administrators and assigns by these presents in manner and form following that is to say that he the said Jn Poulter his executors administrators and assigns or some or one of them shall and will as soon as the said sum of 620li shall fully be levied and received in clear profit and beyond all deductions to be made for the same out of the rents issues and profits of the said messuages lands and premises by the said Jn Poulter his executors administrators and assigns render and give unto the said Hen Abbutt his executors administrators and assigns a true perfect and just account of such sum and sums of money matters and things which shall be had and received or come to the hands or possession of the said Jn Poulter his executors administrators or assigns and that he the said Jn Poulter shall and will as soon as he or they shall be fully satisfied and paid the said sum of 620li according to the true intent and meaning of these presents at the costs and charges of the said Hen Abbutt his heirs or assigns reconvey release and discharge the said messuages lands and premises with appurtenances unto the said Hen Abbutt his heirs or assigns and the said Hen Abbutt for himself his heirs executors administrators and assigns doth covenant promise and agree to and with the said Jn Poulter his executors administrators or assigns by these presents that he the said Hen Abbutt at the time of the sealing and delivery of these presents hath good right full power and lawful and absolute authority to grant convey and assure the said messuages lands tenements hereditaments and premises with their appurtenances unto the said Jn Poulter his executors administrators or assigns in manner and form aforesaid according to the true intent and meaning of these presents and that it shall and may be lawful to and for the said Jn Poulter his executors administrators or assigns from time to time and at all times during the said term of one and twenty years quietly and peaceably have hold use occupy possess and enjoy the said messuages tenements hereditaments with their appurtenances without any let suit trouble interruption or disturbance of the said Hen Abbutt his heirs or assigns and that free and clear of and from all other titles troubles charges and encumbrances whatsoever the ancient and accustomed rents and services that shall become due to the lord or lords of the fee or fees of whom the same premises are holden only excepted in witness whereof the said parties to these present indentures interchangeably have set their hands and seals the day and year first above written Hen Abbutt sealed and delivered
