whereas at a court with view here held on the tuesday in pentecost week 12Hen4 it was presented that Jn Besouthe died holding on the day that he died from the lady one croft of land containing 3a and on his death bed at Tey surrendered into the hands of Walt Davy to the use of Jn Parle and his heirs in the presence of Jn Baron and Wm Salle the aforesaid croft and concerning which the court established by the aforesaid inquisition that the aforesaid Jn Bokelard (sic) and Wm Salle were not tenants of this manor and thus not sufficient persons according to the custom etc to testify the previous possession of the aforesaid surrender and thus the aforesaid surrender is void and they say further that nothing accrued to the lord as heriot because he had nothing within the jurisdiction of the aforesaid court and they say that he had two sons Wm and Jn and who was the elder of them is not known therefore it was presented to seize into the hands of the lord to return of the profits until a court should better advise of the said parties etc therefore it was presented to seize into the hands of the lord until etc and to return to the lord of the profits etc
