showing of a deed of acquittance of rent | whereas Jn Ashford lately upon the naming of a rental was levied at 18d rent per annum for one cottage with garden adjoining sometime of Jn Peteman at Tolhousgrene now to this court came the same said Jn and sought discharge of 12d of the aforesaid 18d by his deed shown in court and signed in these following words know for the present and future that I Robt de Veer earl of Oxford give grant and by this my present deed confirm to my well beloved Rich de Claketon and Olive his wife for their services two pieces of my land in the village of Great Colne of which one piece of land lies between my land which is called The Berecroft on one part and a messuage of the aforesaid Rich and Olive on the other part and that piece of land contains in length 13rod and in breadth 2rod and a half of land and that piece of land lying between my market square of Colne on one part and a messuage of the said Rich and Olive on the other part and containing in length 10rod and in breadth 20ft to have and to hold the aforesaid two pieces of land with all their appurtenances from myself and my heirs to the aforesaid Rich and Olive his wife and their heirs or assigns and whenever the aforesaid two pieces of land with their appurtenances be given sold or in any other manner assigned as they wish to use in true quiet and in peace forever returning thereof annually to myself and my heirs of the aforesaid Rich and Olive his wife and their heirs and assigns 6d viz for the rent of the first piece of land 4d and for the other piece of land 2d namely at the feast of michaelmas 2d and at easter 2d and at the feast of the nativity of st john baptist 2d for all services and customs and other duties demanded and I the aforesaid Robt de Veer earl of Oxford and my heirs the aforesaid two pieces of land with all their appurtenances to the aforesaid Rich de Claketon and Olive his wife and their heirs or assigns by the aforesaid free services warrants and defends against all men forever in which matter testifyi ng this present deed signed with my approval with these divers testimonies Reg de Argenhan Jn Carbonell Hen de Lacy Jn de Belle Campo knight Simon of Kensington Nich of Aumberdon Jn de Bery Wm de Langham Jn de Potelecote Ralph Coste and others and because it was testified here in court by the whole homage that the said rent returned and paid to the lord at the terms for the manor of Colne for the aforesaid fee ought to be as by the aforesaid deed it was specified and thus always it had been in the past and was confirmed by the tenants thereof and not otherwise except by the neglect of the lord's tenants in contradicting as it was put in the new rental against the conscience and unjustly therefore it was considered upon the discretion of the steward that the said rent should be removed rescinded and that the same said Jn and his heirs were discharged of the rent in the new rental as it was unjust to repay to the lord for the said fee in the manner and form and to hold by the abovesaid deed etc |
