fine 3s4d to this court came Thos Hunte and Wm Clerke who held jointly with Robt Turnebull now deceased to them and their heirs to the use of the same Robt of the lord by the rod according to the custom of the manor one messuage and 10a customary lands with the appurtenances in Colne aforesaid late Robt Illies and for the accomplishment and execution of a certain covenant and bargain which the said Robt Turnebull in his natural life made with Wm Goldwire of Coggishall of and upon the sale of the premises on condition of payment of divers sums of money to the foresaid Robt viz 20li13s4d whereof the said Robt in his life received of the foresaid Wm Goldwire 8li13s4d as is sufficiently is witnessed by the homage and surrendered into the lord's hands the foresaid messuage and 10a of land with the appurtenances to the use of the said Wm Goldwire his heirs and assigns which Wm Goldwire being present in the court came and craved himself to be admitted thereunto and he is admitted the lord's tenant to whom by the lord's steward there is seisin thereof delivered to hold to him and his heirs of the lord by the rod to the will according to the custom of the manor and he giveth for fine and made fealty yet this surrender and seisin thereof delivered is made on condition following viz that if the foresaid Wm Goldwire or his certain attorney or executor pay or cause to be paid to one Fonteis alias Butler or his certain attorney or executor 12li viz in the feast of pentecost next coming after the date of this court 40s and so forth yearly from year to year always in the feast of pentecost 40s until the said sum of 12li be fully paid and satisfied that then this present surrender and seisin thereof delivered stand and take effect in his full force and for default of payment of any of the payments contrary to the form aforesaid that thenceforth it shall be lawful to the foresaid Thos Hunte and Wm Clerke and their heirs into the foresaid messuage and 10a of land with the appurtenances by the licence of the court to reenter have again and repossess to the use of the foresaid Jn Fonteis and the said Wm Goldwire his heirs and assigns from thence wholly to expel and remove this present surrender and seisin thereof delivered in any thing notwithstanding
