Chas Hayes gentleman and Mary his wife by Edw Reade their attorney complain against Geo Chressener gentleman of a plea of land viz of one messuage 20a of land 5a of meadow and 15a of pasture customary with the appurtenances in Earls Colne within the jurisdiction of this court and make protestation to prosecute the plea in the nature and form of a writ of our sovereign lady the queen of formedon in the descend at the common law according to the custom of the manor and pray process to be made unto them against the foresaid Geo to be here at the next court to answer the foresaid Chas and Mary of the plea aforesaid and pledge to prosecute Jn Doe Rich Roe and thereupon the said Chas Hayes and Mary his wife pray against Geo Chressener the foresaid tenements customary with the appurtenances which Sibil Wro widow deceased according to the custom of this manor surrendered into the lord's hands and then of the manor aforesaid to the use and behoof of Jn Chressener gentleman and Sibil his wife deceased and the heirs of their bodies issuing to which Jn and Sibil the lord of the manor then being by his said steward granted seisin thereof to hold to them and the heirs of their bodies issuing and which after the said Jn and Sibil his wife and after the death of Thos Chressener the elder son and heir of the bodies of the foresaid Jn and Sibil issuing to the foresaid Mary as cousin and heir of the foresaid Jn and Sibil his wife viz the only daughter and heir of the foresaid Thos Chressener issuing son and heir of the bodies of the said Jn and Sibil his wife issuing according to the custom of the manor aforesaid ought to descend according to the form of the surrender and gift aforesaid and whereupon the said Chas Hayes and Mary his wife say that the foresaid Sibil Wro according to the custom of the manor aforesaid surrendered the customary tenement aforesaid with the appurtenances into the lord's hands of the manor aforesaid for the time being to the use and behoof of the foresaid Jn Chressener and Sibil his wife and the heirs of their bodies issuing to which Jn and Sibil his wife the lord of the manor aforesaid there being by his steward granted seisin thereof to hold to them and the heirs of their bodies issuing in form aforesaid according to the custom of the manor aforesaid by force whereof the foresaid Jn and Sibil were thereof seised in their demesne as of fee in the time of peace in the time of the queen that now is taking the issues thereof etc and after the death of the foresaid Jn and Sibil and after the death of the foresaid Thos Chressener son of the same Jn and Sibil his wife the right of the tenements aforesaid descended by the form of the surrender and gift aforesaid and according to the custom of the manor aforesaid to this Mary that now prayeth the same as cousin and heir of the body of the foresaid Thos issuing the son and heir of the foresaid Jn and Sibil his wife viz the only daughter and heir of the body of the said Thos issuing the son and heir of the foresaid Jn and Sibil his wife issuing because that the customary lands and tenements of the manor aforesaid by any customary tenants of the same manor upon a surrender and gift in this and the same manner prescribed as appointed or set forth from time to time out of mind since when there is no custom to the contrary hath been used to be letten surrendered and given and the right ought to descend to the heirs of the bodies of those persons to whose uses the same surrender and gifts were made and did happen to be made by the form of the same surrender according to the custom of the manor aforesaid and which after the death etc and thereupon they bring their suit
