whereas at the court here holden in the 29Eliz1 Edm Potter took to him and his heirs by copy of court roll of the surrender of Hen Bridge all that messuage or tenement called Dynes with appurtenances and four parcels of land and pasture late parcel of Lowefield containing in them by estimation 20a be it more or less in as ample manner and form as the same Hen lately had the same of the surrender of Wm Booner on condition that the same Edm Potter his heirs of assigns should pay or cause to be paid to the said Hen Bridge yearly during his natural life 10li of good and lawful money etc at the messuage or tenement aforesaid at or before annunciation and michaelmas by even portions as in the said court appeareth now it is found by the homage of this court that the same Edm Potter hath not paid nor caused to be paid to the said Hen Bridge the said yearly payment of 10li at the place and feasts aforesaid as he ought to have done by force of the condition aforesaid from the day of the date of the said court and that the said Hen Bridge by the occasion of the breach of the condition aforesaid hath reentered on the tenement aforesaid with appurtenances as was lawful for him to do and the same hath again possesseth and enjoyeth as in his former estate the said admission by virtue of the said surrender in any wise notwithstanding and the same Edm being likewise required to show if he had or could say anything for himself to maintain his estate aforesaid to the foresaid tenement by virtue of the foresaid surrender came not nor showed anything in proof of the performance of the said condition and hereupon the same Hen Bridge came here to this court in his own proper person and prayed himself to be readmitted the lord's tenant to the premises with appurtenances according to the tenor of his former admission and because it is manifest to the court that his claim is true therefore the lord by his steward aforesaid delivered him seisin thereof by the rod according to the custom of the manor to have to him and his heirs to hold of the lord by the rod to the will of the lord according to the custom of the manor and by fealty suit of court and rent of 13s8d by the year and by all other customs and services therefore before due and of right accustomed and the foresaid Hen made fine with the lord for his readmission aforesaid and is admitted the lord's tenant thereof etc and afterwards the same Hen Bridge came in his own proper person in the full court and in consideration of 20li of lawful money etc to him beforehand paid by one Randall Greene surrendered into the lord's hands by the hands of the said steward all his customary lands and tenements called Dines and Lowefield with appurtenances in Earls Colne except and reserved all manner of woods and underwoods thereupon growing to the foresaid Hen Bridge his heirs and assigns to the use and behoof of Randall Greene his executors and assigns from michaelmas now last past until the end and term of nine years from thence next coming and fully to be complete and ended yielding and paying therefore yearly to the said Hen his heirs and assigns a certain rent of 40s of lawful money etc at annunciation and michaelmas at or in the messuage aforesaid or within 10days next after every of the foresaid feasts and further yielding and paying to the lord and his heirs and assigns the yearly rent of 13s8d at the usual terms of the manor and the same Hen by the lord's licence doth well grant for him his heirs executors and assigns to and with the said Randall his executors and administrators that it shall be lawful to the said Randall and his assigns yearly during the said term to take cut and have at meet and seasonable times sufficient and competent houseboot cartboot ploughboot and hedgeboot to be spent in and upon the premises and not elsewhere and the same Randall and his assigns in consideration thereof shall from time to time sufficiently repair the buildings and enclosures of the premises and the same so repaired in the end of the said term shall leave and yield up to the said Hen Bridge his heirs or assigns and if it shall happen the foresaid yearly rent of 40s or any part or parcel thereof to be behind in part or in all after any of the said feasts in which as abovesaid it ought to be paid by the space of 20days or if the buildings or enclosures of the premises happen not to be repaired that then and from thence it shall be lawful to the said Hen his heirs and assigns into all the foresaid lands and tenements with appurtenances to reenter and the same to have again possess and enjoy as in their former estate this present surrender in any wise notwithstanding provided always that if the said Hen his heirs or assigns pay or cause to be paid to the said Randall his executors or administrators the sum of 20li of lawful money etc at or in the messuage aforesaid within the first year of the said term without fraud or deceit or if it happen the said Hen or his assigns to be disposed to dwell upon or occupy the premises or to let the same to any other that then the said Randall his heirs executors administrators or assigns upon notice thereof at any michaelmas after the end of the first year of the said term at michaelmas next coming after such notice given to them or any of them shall quietly surrender and leave the lands and tenements aforesaid with appurtenances and the possession thereof to the said Hen or his heirs or assigns to which Randall the lord by his steward aforesaid delivered seisin there of by the rod to hold to him for the term aforesaid for the conditions and considerations aforesaid etc
