nine she hath many times heard the said defendant Rose when this deponent was servant unto the now complainants talk of certain legacies or portions of 20li apiece given by her said husband Cuckoe unto every one of her children which she had by him the said Rose always saying that she had paid some of the said legacies and would pay the residue and whereas one of the children of the said defendant Rose being a daughter dying unmarried and not having in her lifetime received her said legacy of 20li left her by the said mr Cuckoe her father gave her said 20li then being in the hands of the said defendant Rose unto the now complainants this deponent hath heard the complainant Ralph Lunt divers times as the said Rose hath been sitting at the table and sometimes by the fire and elsewhere say unto the said defendant Rose thus viz " mother when will you pay me my 20li when shall I have my 20li which my sister Susan gave me " whereunto the said defendant Rose hath divers times in this deponent's hearing answered saying " by my troth Ralph thou shalt have it one day I will pay thee that 20li and all other money that I owe thee and thy wife for my diet and lodging and for all thy pains taken for me in my business but now I have no money to spare Partridge meaning the said Robt Partridge her then husband maketh me spend all my money in suits of law against him " or words to that effect
