item to the seventeenth interrogatory this deponent saith that she heard her aunt Salter say that her uncle Partridge had mortgaged the lands now in question to her two uncles Gurling and Salter and that the said Partridge had no right in the same but the interest was in the complainant Rose and this deponent further saith that she heard her said aunt Salter say that she feared that her brother Partridge would undo them all by mortgaging of those lands which the said Partridge had no interest in and further this deponent saith whether the lands now in question were surrendered back or no she knoweth not and further to this interrogatory she cannot depose
