between Edw Rosse and Rose his wife complainants and Rich Harlakenden esq defendant according to your lordship's order of 21.7.last I have considered of the interrogatories and depositions and am of opinion that the fourth interrogatory of the part of the plaintiffs was unfitly administered and that as well the said interrogatory as the deposition of Robt Parker Simon Ive and Hen Abbott to that fourth interrogatory are fit to be suppressed as well for that it is unfit to question as that interrogatory doth what speeches past from judges at a trial many years since as also because they tend to the disgrace of the defendant mr Harlakenden being a gentleman of quality and of his court rolls and likewise I hold the fifth interrogatory of the plaintiffs part unfit and that as well the interrogatory as the deposition of Robt Parker Simon Ive and Hen Abbott to the said fifth interrogatory are likewise fit to be suppressed both because they question what speeches were used by judges at a trial long since had and likewise do tend to the discredit of Jn Parker who is no way party nor witness to the suit which nevertheless I leave to your lordship's wise consideration 9.10.1623 Hen Halam#
