to all christian people to whom the present writing shall come Sam Nuton of Emsted in the county of Essex husbandman sendeth greeting whereas Susan Newton late of Earls Colne in the said county widow deceased did in and by her last will and testament in writing bearing date the 27.4.1690 did amongst other things give and bequeath unto her daughter Susan Newton and her heirs forever all her houses and lands whatsoever and wheresoever both freehold and copyhold with all and every their appurtenances but in case her daughter Susan Newton should depart this life before she should attain her age of 21yr then she gave all her said lands both freehold and copyhold and appurtenances to the same belonging unto her two brothers in law Jn Newton and Sam Newton and their heirs forever as and by the said recited will relation being thereunto had more fully it will appear and whereas the said Susan Newton the daughter departed this life before she attained her age of 21yr by reason whereof all the houses and lands both freehold and copyhold with the appurtenances which the said Susan the mother died possessed of or any interest in same to the said Jn Newton and Sam Newton her brothers in law and their heirs by virtue of the said recited will now know ye that I the said Sam Newton for and in consideration that the said Jn Newton hath by lawful conveyance released all h is right and title to me the said Sam Newton and my heirs of and in all that freehold messuage or tenement with the yards backsides barns stables and outhouses to the same belonging with the lands and all other the appurtenances thereunto belonging situate lying and being in Much Birch in the said county and now in the tenure and occupation of Jn Lymmer as also for divers other good causes and valuable considerations me the said Sam Newton thereunto moving hath remised released and forever quitclaimed and by this my present writing under my hand and seal do for me my heirs executors and administrators fully clearly freely and absolutely remise release and forever quitclaimed unto the said Jn Newton and his heirs forever now being in his full and peaceable possession and seisin all the right title estate interest reversion property equity claim and demand whatsoever or howsoever which I the said Sam Newton now have or ought to have either by the said recited will or by any other way or means howsoever or whatsoever or which my heirs executors or administrators now have or hereafter shall have and claim or pretend to have or claim of in or out of all that copyhold messuage or tenement houses outhouses barns stables yards garden lands and appurtenances whatsoever as the same are situate lying and being in Earls Colne aforesaid and now in the tenure and occupation of Robt Marriage and the said Jn Newton and holden of the manor of Colne Priory by any manner of ways or means whatsoever to have and to hold the said copyhold messuage or tenement lands and all other the hereditaments aforementioned premises with the appurtenances unto the said Jn Newton his heirs and assigns to the only proper use and behoof of the said Jn Newton his heirs and assigns forever so that neither the said Sam Newton nor his heirs nor any other person or persons for me or in my name or in the name or names right or steads of any of them shall may or will by any way or means hereafter have claim challenge or demand any estate right title or interest of in or to the aforementioned premises or any part or parcel thereof but from all and every accord right estate title interest claim or demand of in or to the premises or any part or parcel thereof I and every of my heirs executors and administrators and all and every other person or persons claiming or pretending to have or claim shall be utterly excluded and barred forever by these presents and also that I the said Sam Newton and my heirs the said copyhold messuage lands and all their the herein aforementioned premises with every of their appurtenances to the said Jn Newton his heirs and assigns to his and their own use and uses in manner and form aforesaid against me and my heirs and assigns and every of us shall and will warrant and forever defend by these presents and lastly that I the said Sam Newton and my heirs and all others claiming under me shall and will at the reasonable request cost and charges in the law of the said Jn Newton and his heirs make do and execute any further or other lawful conveyance for the further and better releasing and confirming and sure making of the herein aforementioned messuage lands and premises so that the same may be wholly settled upon the said Jn Newton and his heirs forever as the counsel of the said Newton lea rned in the law shall reasonably advise in witness whereof I the said Sam Newton have hereunto set my hand and seal this 27.3.1694 sealed and delivered in the presence of us (no signatures)
