this indenture made the 24.9.5Jas1 between Rich Harlakenden of Earls Colne in the county of Essex esq and Thos Harlakenden brother unto the said Rich on the one part and Clem Stonard of Stapleford Abbot in the said county esq and Jn Jocelin of Greys Inn in the county of Middlesex esq of the other party witnesseth that the said Rich Harlakendene and Thos Harlakendene for divers and sundry good and weighty causes and considerations them thereunto especially moving do covenant and grant for them their heirs executors and administrators to and with the said Clem Stonard and Jn Jocelin and either of them their and either of their heirs executors and administrators by these presents that the said Rich and Thos Harlakendene before the feast day of the purification of our blessed lady the virgin mary next ensuing the date of these presents shall and will by fine in due form and order of law to be levied with proclamations thereupon to be had according to the statute in that case made and provided convey and assure all that the manor or lordship of Earls Colne alias Colne Comitis in the said county of Essex and all and singular dovehouses houses barns stables buildings yards gardens orchards lands tenements meadows pastures feedings woods underwoods leets liberties franchises advowsons and hereditaments whatsoever to the said manor belonging or in anywise appertaining or accepted reputed or taken as part parcel member or belonging of or to the said manor or demised used or occupied to or with the same and also all that part of the park parcel of land commonly called or known by the name of Colne Parke which lieth divided from way lately laid and that leadeth from Earls Colne aforesaid in the said county of Essex towards Markshall and lying on the east side of the said way towards Coggeshall containing by estimation 360a now or lately in the tenure or occupation of the said Rich Harlakenden or his assigns in or upon part of which said park or parcel of land the said said Rich Harlakendene hath now newly erected one messuage or tenement and also all that messuage or tenement commonly called or known by the name of the Great Lodge situate standing and being in the disparked park of Colne commonly called Colne Parke in Earls Colne aforesaid and of all the houses edifices buildings orchards and gardens to the same belonging and also of all those arable lands meadows pastures and woodgrounds with their appurtenances containing by estimation 380a parcel of the said disparked park lying likewise in Earls Colne aforesaid now unto the said Great Lodge divided from other lands of the said Rich Harlakendene in Earls Colne aforesaid by a certain way lately made and laid out from Earls Colne towards Markshall directly across Colne Parke and do extend from the said way towards the west and now being in the occupation of the said Thos Harlakendene or his assigns and also one meadow called Hall Meadow in Earls Colne aforesaid containing by estimation 14a in Earls Colne aforesaid and also one little pasture or croft containing by estimation 1a in Earls Colne aforesaid between Hall Meadow and the highway and also one small pightle or meadow in Earls Colne aforesaid lying between Hall Meadow and the river in the occupation of the said Thos Harlakendene or his assigns and also all that messuage or tenement with the appurtenances in Earls Colne aforesaid situate in the said late disparked park now or late in the occupation of Nich Kendall or his assigns containing by estimation 93a of land meadow and pasture with the appurtenances in Earls Colne aforesaid lying along by the aforesaid 380a towards the west now or late in the occupation of the said Nich Kendall or his assigns and of one other messuage with a croft adjoining and of one hopround or parcel of meadow containing by estimation 4a late parcel of the Hall Meadow in Earls Colne aforesaid in the occupation of one Robt Cobbe gentleman or his assigns and of two other small tenements with the appur tenances adjoining to the late recited messuage in Earls Colne aforesaid late in the occupation of one Robt Piggott or his assigns and also all that part or parcel of woodland commonly called or known by the name of Bettingsland Wood with the appurtenances containing by estimation 36a now in the occupation of the aforesaid Thos Harlakendene unto the said Clem Stonard and Jn Jocelin and their heirs or to one of them by such name and names and in such manner and form as by the said Clem Stonard and Jn Jocelin or the survivor of them or their or any of their counsel learned in the law shall be reasonably advised or devised with fine so to be levied and all other fines feoffments conveyances and assurances at any time or times hereafter and before the said feast day of the purification next ensuing after the date of these presents to be had made or executed by or between the said parties to these presents or any of them of the premises or any part or parcel thereof shall be adjudged esteemed and taken to be to such uses behoofs purposes and intents as in and by these presents is limited and appointed and to none other use intent or purpose that is to say of all that the manor lordship of Earls Colne alias Colne Comitis in said county of Essex and all and singular dovehouses houses barns stables buildings yards gardens orchards lands tenements meadows pastures feedings woods underwood leets and liberties franchises and hereditaments whatsoever to the said manor belonging or anywise apperta ining or accepted reputed or taken as part parcel and member or belonging of or to the said manor or demised used or occupied to or with the same and of all that part of the park or parcel of lands commonly called or known by the name of Colne Parke which lieth divided from the way lately laid out that leadeth from Earls Colne aforesaid in the said county of Essex towards Markshall and lying on east side of the way towards Coggeshall all containing by estimation 360a now or late in the tenure or occupation of the said Rich Harlakendene or his assigns together or with the said messuage or tenement now newly erected and builded in and upon part of the said park or parcel of ground with all their and every of their appurtenances to the said park or parcel of ground messuage or tenement in anywise belonging or appertaining or therewith all used occupied or enjoyed to the only use and behoof of the said Rich Harlakendene his heirs and assigns forever more and to none other use intent or purpose and of all that messuage or tenement commonly called or known by the name of the Great Lodge situate standing and being in the said diparked park of Colne commonly called Colne Parke in Earls Colne aforesaid and of all the houses edifices buildings orchards and gardens to the same belonging and also of all those arable lands meadows pastures and woodgrounds with their appurtenances containing by estimation 380a parcel of the said disparked park lying likewise in Earls Colne aforesaid near unto the said Great Lodge divided from other lands of the said Rich Harlakendene in Earls Colne aforesaid by a cartway lately made and laid from Earls Colne towards Markshall directly across Colne Parke and do extend from the said way towards the west and now being in the occupation of the said Thos Harlakendene or their (sic) assigns and also one meadow called Hall Meadow in Earls Colne aforesaid containing by estimation 14a in Earls Colne aforesaid and one little pasture or croft containing by estimation 1a in Earls Colne aforesaid between Hall Meadow and the highway and also one small pightle or meadow in Earls Colne aforesaid lying between Hall Meadow and the river in the occupation of the said Thos occupation of one Robt Cobbe gentleman or his assigns and of two other small tenements with the appurtenances near adjoining unto the late recited messuage in Earls Colne aforesaid late in the occupation of Robt Piggott or his assigns part parcel of woodland commonly called or known by the names of Bettingsland Wood with the appurtenances containing by estimation 36a in the occupation of the said Thos Harlakendene with all and every of their and either of their rights members and appurtenances to them or either of them belonging or appertaining to the only use and behoof of the said Thos Harlakenden his heirs and assigns forever more and to no other use intent or purpose in witness whereof the parties above mentioned interchangeably have set their hands and seals the day and year
