in the name of god amen the 26.10.1599 etc I Thos Smith of Earls Colne in the county of Essex tanner being sick in body but of perfect mind and remembrance thanks be given to god do make and ordain this my testament containing therein my last will in manner and form following first I commit my soul to almighty god my creator and maker and to jesus christ my saviour only redeemer and to the holy ghost and preserver and my body to be buried in the churchyard of Earls Colne aforesaid first I give unto Joan my wife all such implements of household stuff which is now in my house that was hers before I was married unto her to be presently delivered unto her after my decease also I give unto Joan my wife 14li of good lawful english money to be paid unto her within ten months after my decease if she die within ten months then the foresaid 14li to remain to Jane Hammond Eliz Smith and Jn Smith my children to be equally divided amongst them three within ten months item I give to Jane Hammond my daughter 5li13s4d of good lawful english money to be paid within twelve months after my decease also I give unto Jane my daughter my four stills with all things thereunto belonging one still to be delivered presently after my decease item I give Eliz my daughter 6li13s4d of lawful english money to be paid unto her within three months after her day of marriage or at twenty four years of age whichsoever cometh first if she happen to die before she come to 24yr of age or to be married then I will her part to remain to Thos Smith Jn Smith and Jane Hammond my three children to be divided by equal portions item I give to Jn Smith my son 10li of good lawful english money to be paid unto him by mine executor at the age of 22yr if it shall happen my said son Jn die before he accomplish the age of 22yr then I will and my meaning is that the foresaid 10li to be equally divided betwixt my children which shall be then living that is to say Thos Smith Eliz Smith and Jane Hammond item I will that Thos Smith my son shall pay or cause to be paid unto his brother Jn Smith 10li by the year till he accomplish the age of 22yr which money is to be paid in consideration of the 10li for his better maintenance by 10s the quarters also I do ordain and make to this my last will and testament Thos my son my only and sole executor to this my testament and last will and Wm Adhams vicar of Earls Colne and Hen Abbott jun my supervisors to see this my last will and testament performed and I do give to Wm Adhams for his pains taken herein my limbeck and my glass still both head and body and the stillatory for roses and my gold ring these stills given before to Jane Hammond my daughter I do give to Wm Adhams aforesaid and I do give unto Hen Abbott jun 3li of good english money to be paid within six months next after my decease in witness whereof I have put my hand and seal the day and year first above written by me Thos Smith read sealed signed and delivered in the presence of us Wm Adhams clerk Hen Abbott jun by me Franc Hampton scriptor
