in the name of god amen the 24.5.1613 etc. I Jn Aylett of Kelvedon in the county of Essex yeoman being sick in body but of sound and perfect memory thanks be to god do ordain and make this my last will and testament in manner and form following revoking all other former wills and bequests whatsoever first I commend my soul unto almighty god my maker saviour redeemer and comforter and my body unto the earth to be decently buried by the good discretion of mine executors item I give unto the poor of the parish of Kelvedon aforesaid 3li to be distributed within one month after my decease item I give and devise to Eliz my well beloved wife for her jointure and in full recompense of her thirds and title of dower in or to all other or any of my lands tenements and hereditaments the legacies in this my will that is to say my messuage wherein I dwell in Kelvedon aforesaid and all the houses buildings lands meadows and pastures freehold and copyhold to or with the same used or occupied situate lying and being in Kelvedon aforesaid and in Much Braxted in the county aforesaid or either of them with all and singular their appurtenances except the croft called Grayes to have and to hold unto her for and during the term of her natural life if she shall so long live sole and unmarried and if she shall happen to marry then I will that the same my devise to her shall cease and determine and that then and from thenceforth I will that my son Thos Aylett his heirs or assigns shall pay out of the same premises unto the said Eliz yearly during her life 30li at the feast of michaelmas and annunciation by equal portions at the messuage aforesaid and after the marriage of my said wife or her death first happening I give and devise all the said messuage houses lands meadows and pastures with appurtenances unto my said son Thos and his heirs forever item I give unto my said wife all my wood in my yard of the said house or messuage aforesaid and one half of all my plate household stuff and implements utensils of household and the other half to my two sons Wm and Thos item I give and devise unto my said wife the one half of all my corn as well of that growing on the ground as that in the chambers and the other half thereof I likewise give to my said two sons item I give more unto my said wife 100li of lawful english money to be paid her by mine executors within one week after my decease item I give her more all my swine hens ducks geese turkeys and pullen whatsoever item I give her my seven kine and a bull wholly notwithstanding my former devise item I give and devise unto my eldest son the foresaid Wm Aylett and to his heirs forever all my lands tenements meadows pastures and hereditaments in Much Totham and Heybridge in the said county item I give and devise further unto the said Wm Aylett and to his heirs forever all my messuage called Prucknetts and all other my lands tenements meadows pastures and hereditaments in Earls Colne in the county aforesaid upon condition and to the intent that my said son Wm his heirs or assigns shall pay or cause to be paid unto Susan Eliz Dorcas and Ann my daughters 100li apiece of lawful english money at their several and respective ages of 21yr and if any of my said daughters shall happen to die before she shall come to that age then the part portion or portions of her or them so deceasing shall be paid to the residue of my said daughters surviving at such time as it should have been paid if those parties had still lived and that if my said son shall make default of payment of any of my said daughters portions then I will that the messuage and all other the premises in Earls Colne aforesaid shall be sold by my brother Thos Aylet or his executor or executors within one year after such default made and with the money thereof coming pay my said daughters portions and pay the surplusage of the money to be received upon such sale unto my said son Wm or his heirs item I give unto the said Wm my son and his heirs forever all that my messuage or tenement called Sloyes and all the lands meadows pastures and hereditaments therewith used occupied let or demised with all and singular the appurtenances situate laying and being in Messing in the county aforesaid and my will and mind is that he his heirs or assigns shall pay out of the same yearly unto my said wife 5li of lawful english money during her natural life at the feasts of michaelmas and annunciation by equal portions and if defaults be made of payment thereof in part or in all after any of the said feasts then my said wife or her assigns shall or may distrain for the same upon the premises in Messing as for a rent charge of distress item I give and devise unto my foresaid son Thos Aylett my mill millhouse messuage croft and meadow called Grayes in Kelvedon aforesaid with all the freehold and copyhold therewith used or demised or as part or parcel thereof reputed to have and to hold to him and to his heirs forever item I give unto my said son Thos my house called Thebalds and all the lands pastures and hereditaments tenements used or occupied or as part or member thereof being situate lying and being in Inworth in the county aforesaid to have and to hold to him and his heirs forever also I give unto the same Thos and to his heirs forever my customary lands and tenements called Whitwells in Inworth aforesaid and all my lands in Messing called Saint Mary Lands and all my woods therewith all and singular their appurtenances to have and to hold to him and to his heirs forever upon condition and to the intent nevertheless that the said Thos his heirs or assigns shall pay unto my aforesaid four daughters 100li apiece at their several and respective ages of 21yr and if any of them happen to die before that age then the portion or portions of her or them so deceasing shall be paid to the residue of my daughters surviving at such time as it should have been paid if those parties so deceasing had still lived and if default be made of payment of any of my said daughters portions so to be paid by my son Thos or his heirs then I will that the said lands tenements and premises so given to my said son Thos in Messing and Inworthe aforesaid shall be sold to my foresaid brother Thos his executor or executors within one year after such default made to pay the said 100li apiece portion to my daughters and the surplusage of the money to be received of the said sale to be delivered to my said son Thos or his heirs item I give and devise unto my said wife during her natural life an annuity or yearly rent charge of 5li to be issuing and paying out of the foresaid lands tenements and other the premises in Messing and Inworthe aforesaid devised unto my son Thos at the feasts of michaelmas and annunciation by equal portions with clause of distress for non payment thereof after any of the same feasts and I give to my said wife seven sheep and five lambs all my mares horses and colts I give unto my foresaid two sons to be equally and indifferently parted between them together also with my heifers and bullocks item I give unto Roger Bird that dwelleth with me 40s at his age of 21yr to be paid by mine executors all my armour I give to my said son Wm and I do nominate and appoint my said two sons Wm and Thos executors of this my will in witness whereof to both the sheets of paper wherein my will was is written I have subscribed my name the day and year first above written and have published the same for my last will in the presence of the witnesses undernamed viz Jn Aylett viz
