in the name of god amen this 20.11.1649 I Hen Ennewe the elder of Great Coggeshall in the county of Essex clothier being aged and sick in body but of good and perfect memory thanks be given to almighty god do make and ordain this my last will and testament in manner and form following revoking and hereby making null and void all other wills by me formerly made imprimis I commit my soul into the hands of almighty god my most merciful creator assuredly trusting through the merits of jesus christ to have full remission of all my sins and to rest with him in glory and my body I commit to the earth to be decently buried at the discretion of my executors hereafter named and as touching the disposal of that temporary estate wherewith god hath blessed I dispose thereof as followeth viz imprimis I give unto mr Jn Owen of Coggeshall aforesaid the sum of 40s to be paid within one month next after my decease item I give to the poor people there 5li of lawful english money and to and amongst the poor people of Tolshunt Darcie and Tolshunt Beckingham 20s of like money the same sums of money to be paid and distributed amongst them by my executors in this my will named within one month next after my decease item I give and bequeath unto Hen Ennew my son all those my lands and tenements whatsoever with the appurtenances called Kills Hill in Markeshall which I late purchased of Rich Firner and Hugh Perry and also all those my lands and tenements with every of their appurtenances called Tyle Kilne or howsoever otherwise called for and during the term of his natural life and from and after his decease I give all the said messuages lands and tenements unto my grandchild Hen Ennewe and to the heirs male of his body lawfully to be begotten and for want of such issue unto my grandchild Wm Ennewe and to the heirs male of his body lawfully to be begotten and for want of such issue to the heirs of the body of the said Hen my son lawfully begotten forever item I give unto the said Hen my son all that my tenement with the appurtenances situate in Stonham Streete in Coggeshall aforesaid and now in the tenure or occupation of Rich Wright and all those my customary messuages or tenements with every of their appurtenances called the Blewbore in Coggeshall aforesaid now or late in the tenure of Joseph Clarke and others immediately from and after the payment of my debts and discharge of my legacies herein given thenceforth for and during the term of his natural life and then from and after his decease to the said Hen my grandchild and to the heirs male of his body lawfully to be begotten and for want of such issue unto the said Wm my grandchild and to the heirs male of his body lawfully to be begotten and for want of such issue to the right heirs of the said Hen my son forever item I give unto the said Hen my son all the stock of cattle goods and household stuff whatsoever now being or remaining in his custody at or upon the said farms called Kills Hill and Tyle Kilne or either of them one chest of writings only excepted item I give unto Judith Tanner my daughter a joined chest and a featherbed tick now remaining in her custody item I give unto the said Hen Ennewe my grandchild at his age of 23yr all that my manor or capital messuage with all the lands and appurtenances thereunto belonging which I late purchased of the feoffees of sir Robt Clarke knight deceased and called by the name of Skinners Wicke or howsoever otherwise called and likewise all those my messuages lands and tenements with every of their appurtenances in Coggeshall aforesaid late purchased of mr Chapman and now in the tenure or occupation of mr Rich Benyon Benj Hawes and Thos Hawes their assignee or assigns also all that messuage or tenement with the appurtenances commonly called Longwicke in Goldhanger or elsewhere now in the occupation of Jn Purr his assignee or assigns and likewise my two tenements in Maldon to have and to hold all and every the same last mentioned manor lands and tenements with every of their appurtenances unto the same Hen my grandchild at the said age of 23yr and to the heirs male of his body lawfully to be begotten and for want of such issue then to the use of the said Wm my grandchild at his said age of 23yr and to the heirs male of his body lawfully to be begotten and for want of such heirs to the right heirs of the said Hen my son forever item I give and bequeath unto the said Wm Ennew my grandchild all those my messuages lands and tenements as well freehold as copyhold with every of their appurtenances situate lying and being within the several parishes of Aldham Fordham Earls Colne and Copford by what name or names the same premises or any of them are called or known to have and to hold unto the said Wm my grandchild at his age of 23yr and to the heirs male of his body lawfully to be begotten and for want of such issue to the said Hen my grandchild and to the heirs male of his body lawfully to be begotten and for want of such issue to the right heirs of the said Hen my son forever provided always and my will and mind is that until my said grandchildren Hen and Wm shall accomplish their several ages of 23yr my executors hereafter named shall receive and take the rents and profits of all my said manor messuages lands and tenements hereby devised unto them respectively for and towards the payment of my debts and legacies and for and towards their educations and maintenance and payment of their fines and I devise and do hereby nominate and appoint my said executors hereafter named to be guardians to my said grandchildren until they shall attain unto their several and respective ages before mentioned and I devise that my said grandchildren may be brought up at school and that Hen my grandchild may be educated as a scholar of the University of Cambridge or Oxford and made fit there either for the ministry or for the study and practise of law or physic or else placed out with some able merchant at the discretion of my executors and I do hereby allow unto him for his education and maintenance from the time of his first remaining at the university until his said age of 23yr 40li per annum of lawful english money to be paid him quarterly by my executors out of the rents and profits of the premises hereby devised unto him and my desire is that the said Wm my grandchild should be placed out at school and made fit to be an apprentice with some able clothier or such like tradesman at the discretion of mine executors and then placed out according item I give unto the said Hen my grandchild all those my messuages lands and tenements with the appurtenances commonly called Old Ales in Coggeshall aforesaid to have and to hold to the said Hen my grandchild immediately after he shall attain to his said age of 23yr for and during the term of his natural life and to the heirs male of his body lawfully to be begotten and for want of such issue to the said Wm my grandchild and to the heirs male of his body lawfully to be begotten and for want of such issue to the right heirs of the said Hen my son forever item I give and bequeath unto Sarah Tanner my daughter 20s to buy her a ring and to Wm Tanner the younger Marie Cox Sarah Rebecca and Eliz Tanner children of my said daughter Sarah 20s apiece to buy them rings item I give unto Wm Jepps my grandchild after my debts discharged and paid all those my tenements with the appurtenances in Stonham Streete aforesaid which I late purchased of Wm Sanders to have and to hold thenceforth for and during the term of five years he not doing or permitting to be done any waste or destruction to the same and after the end and expiration of those five years I give all the same premises with the appurtenances unto the said Hen my grandchild and to his heirs forever upon condition that he or they do pay or cause to be paid unto the said Wm Jepps his executor or assigns 100li of lawful english money within six months after the expiration of the said five years item I give unto Marie Ennewe my grandchild 350li of lawful english money to be paid unto her at her age of 21yr and in the mean time as it shall be raised to be put out for her use and benefit item I give and bequeath unto Judith Sarah and Eliz Ennewe children of my said son Hen and every of them 300li apiece of like lawful money of England at their several and respective ages of 21yr and in the mean time as the same shall from time to time be raised as aforesaid to be put forth for their several and respective uses and benefits and if any of the said daughters do die without issue lawfully begotten before their said age of 21yr then my will is that her or their part or portion so dying shall be and remain to and amongst the survivor or survivors of them part and part like and for the better and speedier payment of my debts and performance of this my will and disposing of the rents issues and profits of my said manor lands and tenements as aforesaid my will and mind is and I do desire and direct my executors hereafter named or the survivor of them shall keep a book of receipts and disbursements touching the same and shall every year on the first monday after the feast day of stjn or oftener as they shall think fit until my said grandchildren Hen and Wm shall attain to their said several and respective ages of 23yr aforesaid meet together at some convenient place and make and set out a perfect account betwixt themselves unto and before Thos Talcott gent and Benj Hawes Thos Hawes and Wm Coxe whom I nominate and appoint to be overseers of this my last will or unto or before any two of them as well touching their receipts as touching their disbursements in the precedent year and then the same account of receipts and disbursements to be finally entered and written into another book for that purpose to be kept and provided at the charge of my executors and all the same accounts so from time to time to be made and entered to be by my said executors or the survivor of them subscribed under his or their hands and attested under the hands of my said supervisors or any two of them and the same book of accounts to be safely kept by one of my said supervisors and my will and mind is that if upon the accounts any money shall remain with my said executors at the time when my said grandchildren Hen and Wm shall accomplish their said respective ages of 23yr my debts being first paid and my legacies hereby given and funeral expenses discharged shall be equally divided to and amongst my said grandchildren Mary Judith Sarah and Eliz part and part like and that if any of them shall happen to die before she or they shall receive any part of the same leaving issue behind them lawfully begotten that then the issue of her or them so dying shall have her or their said mother's part thereof equally divided amongst them and further also my will and meaning is that if any of my debts or legacies hereby given shall happen to be behind unpaid at the time when my aforesaid manor lands or tenements hereby given and intended to my said grandchildren Hen and Wm shall come unto them as aforesaid that then they my said grandchildren shall pay and discharge the same debts and legacies then behind betwixt them out of the rents and profits of the premises devised to them as aforesaid each one of them to bear and pay his proportional part thereof according to the value of the rents which he shall receive out of the lands hereby devised unto them or otherwise my said executors shall still receive and take the rents issues and profits of his lands and tenements so refusing or neglecting to bear or pay his part thereof until my debts and legacies shall be fully satisfied and paid all the rest of my goods chattels household stuff and personal estate whatsoever herein not formerly bequeathed I will shall be sold and disposed of by my said executors for and towards the performance of this my will and testament and for the great pains and care to be taken by my executors and supervisors about this my will I do give and bequeath unto my said executors besides their ordinary expenses and charges 50li apiece of lawful english money and to every one of my said supervisors besid es their ordinary expenses thereabouts 20s apiece and of this my last will and testament I do nominate and appoint to be my executors Phil Ennewe and     and that if my said executors or either of them shall refuse to take upon them the execution of this my will then I do hereby make void his and their legacies so refusing or if they or either of them shall happen to depart this life before this my will be fulfilled that then my will and meaning is in case of such refusal or death that my said overseers before mentioned or the survivor or survivors of them shall be executors of this my will and join in all things with my other executor who shall survive or take upon him the execution thereof or otherwise by themselves and for their pains also to be taken about the performance of this my will as executors I give unto them 5li apiece of lawful english money in witness whereof to every sheet of paper of this my will containing eight sheets in number I have set to my hand and to the first sheet thereof only my seal and published the same for my last will and
