(this appears to have been written by two different writers) in the name of god amen this 9.7.1693 etc. I Rich Hayward of Earls Colne in the county of Essex yeoman being sick in body but of good and perfect mind and memory thanks be to god for the same and calling unto mind the uncertain estate of this transitory life and that all flesh must yield unto death when it please god to call I do make constitute ordain and declare this my last will and testament in manner and form following revoking and annulling by these presents all and every other testament will or wills heretofore by me made either by word or writing and this to be taken for my last will and testament and none other and first being penitent and sorry for my sins past most humbly desiring forgiveness of god for the same I give and commit my soul into the hands of almighty god my saviour and redeemer in whom and by the merits of jesus christ I trust and believe assuredly to be saved and to have full forgiveness of all my sins and that my soul with my body at the general day of resurrection shall rise again with joy and through the merits of christ death and passion possess and inherit the kingdom of heaven prepared for his elect and chosen and my body (the rest is in a different hand) to be decently buried by my executors item I give and devise unto my daughter Sara Hayward and to her heirs and assigns forever all that my copyhold messuage or tenement called Parkeroots situate lying and being upon Wakes Colne Greene in the county of Essex and all the lands pastures and meadows thereunto belonging with all and every of their appurtenances by whatsoever name or names any of them are called or known now or late in the occupation of myself and Wm Quilter or one of us and all other my messuages lands and tenements holden of the manor of Wakes Hall or Colne Wakes item I give and devise unto my daughter Rose Hayward and to her heirs and assigns forever all that my freehold messuage or tenement now called the Grey hound and all the lands thereunto belonging containing by estimation 3r more or less with all and every other their appurtenances thereunto belonging now or late in the tenure or occupation of Rich Ellis or his assigns by whatsoever name or names any of them are called or known situate lying and being in White Colne in the aforesaid county of Essex all that which I lately purchased of Wm Clarke item I give and devise unto my daughter Mary Hayward and to her heirs and assigns forever all that my freehold messuage or tenement with the croft of land thereunto belonging containing by estimation 1a more or less with all and ever of their appurtenances by whatsoever name or names the same or any part of them are called or known late in the tenure or occupation of Elethan Midleton and was my late uncle Mich Hayward's situate lying and being in the aforesaid White Colne abutting upon the lands now of Geo Toller gent and Thos Savill blacksmith item I give and bequeath to my son Rich Hayward the sum of 100li of lawful money of England item I give and bequeath to my daughter Sara Hayward the sum of 170li of lawful money of England item I give and bequeath to my daughter Rose Hayward the sum of 170li of lawful money of England item I give and bequeath to my daughter Mary Hayward the sum of 170li of lawful money of England all the aforesaid sums of 170li herein given to my three daughters and the 100li given to my son Rich Hayward my mind and will is that all of them shall be paid by my executors hereinafter named to my brother in law Robt Abbutt of Halstead in the aforesaid county draper within twelve months next after my death and the several sums of 170li given to my aforesaid daughters Sara Hayward Rose Hayward and Mary Hayward to be by the said Robt Abbutt and my father in law Hen Abbutt the aforesaid Earls Colne clothier or the longest liver of them their executors or administrators laid out in the purchasing of messuages lands and tenements as soon as conveniently may be which said messuages lands and tenements so purchased to be settled severally upon my aforesaid daughters Sarah Hayward Rose Hayward and Mary Hayward and their heirs to each of them according to the sum of 170li herein given to them and if it shall so happen that there cannot be messuages lands and tenements purchased just to the several sums herein given to each of my said daughters then what shall after such purchases being made remain in the hands of my aforesaid brother Robt Abbutt and not laid out in purchasing of messuages lands and tenements as is aforesaid the said Robt Abbutt to allow after the rate of 4li for a 100li for a year every year for so much money as remain in his hands after such purchases made as is aforesaid towards the maintenance or bringing up of such daughter or daughters as that the 170li herein given to them is not all laid out upon messuages lands and tenements as is aforesaid towards the maintenance and bringing up of such daughter or daughters until they shall attain their several ages of 21yr or days of marriage which shall first happen and my mind and will is that the 100li given to my son Rich Hayward shall remain in my brother Robt Abbutt's hands for him to make the best improvement for the benefit of my son and to lay out part thereof to bind my son out apprentice item I give my son Rich Hayward my silver tankard item I give to my daughter Sara Hayward my silver cup with two ears and two silver spoons and a silver fork item I give to my daughter Rose Hayward a silver salt and two silver spoons and a silver fork item I give to my daughter Mary Hayward a silver salt and two silver spoons and a silver fork my debts and legacies funeral charges and probate of this my last will and testament being first satisfied and paid all the rest of my goods and chattels I give and bequeath to my executors and my will is that there should not be above 15li spent at my funeral and to this my last will and testament I have hereunto set my hand and seal the day and year above written signed sealed published and declared to be the last will and testament of Rich Hayward in the presence of us
