in the name of god amen I Zach Rogers of Much Tey in the county of Essex clerk being somewhat indisposed in health of body yet by the goodness of almighty god of a sound and perfect memory and understanding do make this my last will and testament first I humbly resign my soul into the merciful hands of almighty god trusting to be saved by and through the sole merits of our lord and saviour jesus christ who died for sinners my body I commit to the earth to be decently buried at the discretion of my well beloved wife Mary with the utmost privacy and as concerning that temporal estate which god hath been pleased to give me I dispose thereof as followeth imprimis I devise to my son Zach Rogers for and during the term of ninety nine years in case he live so long all my messuages lands and tenements whatsoever both freehold and copyhold situate lying and being in Much Tey aforesaid and in Aldham in the said county and from and after the end of the said term determinable as aforesaid then I devise the said premises to every of the son or sons of my said son Zach that shall be living at the time of his death and to his or their heirs and assigns equally as tenants in common and not as joint tenants and for default of such son or sons or in case they all die before their several ages of 21yr and without issue then I devise the same premises to every of my said son's daughter or daughters and their heirs equally as coparceners and for default of issue of my said son Zach then I devise the said premises to Hanamel Rogers and Zach Rogers sons of my son Hanamel Rogers and the heirs and assigns of the said Hanamel and Zach their sons and their heirs equally as tenants in common and not as joint tenants but in case either of them the said Hanamel and Zach the sons shall die before his age of 21yr and without issue then the part of him so dying of the said premises I devise to my grandchildren Geo Rogers and Nehemiah Rogers likewise sons of my said son Hanamel and their heirs equally to be divided between them as tenants in common and not as joint tenants but my will is that my said son Zach and all those to whom the said premises shall come by virtue of this my will shall permit and suffer my maidservant Mary Boggas to hold and enjoy my two tenements parcel of the same in Much Tey aforesaid without any denial or interruption for and during such time as (she) shall remain unmarried and without requiring any rent or satisfaction for the same she keeping the said tenements in tenantable reparations the one whereof is now in the occupation of the widow Denham and the other is untenanted and I give to her the use only for such said time such household stuff and utensils as my wife shall think fit and direct item I devise to my said grandchild Hamamel Rogers and to his heirs forever all that my tenement garden and orchard and lands situate and being in Earls Colne and Colne Engaine in the said county in the tenure or occupation of Jn White item I devise to my son Hanamel Rogers and to his assigns for and during the term of ninety and nine years if he lives so long all that my messuage or tenement gardens orchard with the appurtenances situate and being in Sudbury in the county of Suffolk and from and after the end of the said term determinable as aforesaid I devise the said premises in Sudbury to my said grandchild Zach Rogers and to his heirs and assigns forever item I give to my son Nehemiah Rogers Zach Rogers (inserted) all that my library of books and manuscripts and papers whatsoever my gowns cassocks and apparel item I leave to descend to my said son Zach Rogers his heirs executors and administrators all that tenement and orchard situate in Chappell alias Pontsbright in the said county of Essex in the occupation of Jn Payne item I do by this my will acquit and discharge my said wife and also her daughter kinswoman Mary Grove and all costs and board and other charges by me expended upon or for the said Mary Grove and all costs and charges laid out and disbursed by me in or about my said wife's messuage or tenement and shop in Rochford in the said county of Essex item I give to my said wife 10li of lawful money of England to be paid to her within six months next after my death and I give to my said two grandchildren Geo Rogers and Nehemiah Rogers 15li apiece to bind them out apprentices to some good trades and in case one of them die before he be so bound out then the part of him so dying shall be paid unto the survivor of them item I give to my grandchildren Lydia Rogers and Ann Rogers children of my said son Nehemiah Rogers 20li apiece of like money to be paid to them at their several ages of 21yr or days of marriage which shall first happen and in case either of them die before her legacy be due and payable as aforesaid then the legacy of her so dying shall be paid to the survivor of them and I give to the said Lydia Rogers my cypress chest item I give to my said son Zach 30li of like money to pay his fine upon his admission to the copyhold premises herein aforedevised to him and I give him my silver tankard and my gold ring with my coat of arms engraven thereupon item I do make and appoint my very loving friend and cousin Chas Tyrill esq guardian of the body and estate of my said grandchild Hanamel Rogers and to receive the rents and profits till his full age and make the best improvement thereof to his use item I give to and amongst the poor in Great Tey aforesaid 40s to be distributed at the discretion of my executors and my wife as they shall think fit item I give to my dear and worthy friend Chas Tyrill clerk rector of Sutton in the said county of Essex and to the said Chas Tyrill esq 5li of like money equally to be divided between them whom I make and ordain executors of this my last will and testament lastly all the rest and residue of my goods chattels household stuff and personal estate whatsoever not herein aforebequeathed my debts legacies and funeral expenses being first thereout paid discharged and satisfied I give to my said sons Zach Rogers and Hanamel Rogers equally to be divided between them saving that in case my said wife shall after my death keep house by herself and not board then I give her the use only of any bed and furniture thereto in my dwelling house at her own choice and any other things that she shall have occasion for during such her housekeeping and no longer in witness whereof I have to this my last will and testament contained in two sheets of paper setting my hand and seal to each thereof the
