in the name of god amen I Wm Death citizen and joiner of London being weak in body but of sound and perfect mind and memory praised be almighty god for the same and considering my mortality and the certainty of my death I do therefore make this my last will and testament first and principally I commit my soul into the hands of almighty god my maker and creator not doubting but assuredly believing through the merits and mediation of jesus christ my only saviour and redeemer to receive pardon and forgiveness of all my sins and to inherit everlasting life my body I commit to the earth to be decently buried at the discretion of my executor hereinafter named in full expectation of a glorious resurrection and that when christ who is my life shall appear I shall also appear with him in glory and as for and concerning all and every the worldly estate lands tenements goods and chattels wherewith god hath been pleased to bless me after all my debts are first paid and satisfied I give and bequeath the same in manner followeth first I give and devise to my loving sister Susannah Payne and her assigns for and during the term of her natural life all those my copyhold or customary lands called Mytchells containing 30a be the same more or less with the barn and appurtenances thereunto belonging in the tenure or occupation of Jn Cockerill lying and being in the parish and manor of Earls Colne in the county of Essex she my said sister Susannah Payne committing no waste on the timber or any part of the premises
both estate to sister for life and heirs of her body and after her decease to the copyhold to mr Cressner and the freehold to aunt Porter for her life and after her decease to four daughters to be divided two thirds to Eliz and Susannah and the other third to Mary and Sarah debts and charges of funeral by sister item I give and devise to my said sister Susannah Payne and her assigns for and during the term of her natural life under the several conditions limitations and restrictions hereinafter mentioned all those my freehold lands with the messuage barn hereditaments and appurtenances thereunto belonging called Broad Goris in the tenure and occupation of Wm Porter situate lying and being in the parish of Tay Magna alias Much Tay in the said county of Essex committing no waste as aforesaid item I give and devise to my cousin Edw Cressner citizen and embroiderer of London his heirs and assigns forever immediately after the decease of my said sister Susannah Payne all those my said copyhold or customary lands with their and every of their appurtenances above mentioned item my will and mind is and the said freehold lands and premises so given as aforesaid to my said sister Susannah Payne for her life is upon this condition and limitation that she my said sister Susannah and her heirs do and shall within three months next after my decease by surrender or otherwise by good and sufficient ways and means in the law or custom of the said manor as the counsel of the said Edw Cressner his heirs or assigns shall advise surrender release and confirm to him the said Edw Cressner his heirs and assigns the said copyhold lands and premises to take effect immediately after the decease of my said sister and all her and their claim and interest therein and in case she my said sister and her heirs shall refuse neglect or omit to give or make such surrender and release as aforesaid then and in such case I give and devise my said freehold lands and premises during the said term of my said sister's natural life to my said cousin Edw Cresner and his assigns in lieu and satisfaction of the said copyhold estate so given to him after my said sister's decease as aforesaid and upon this further condition that she my said sister Susannah do and shall well and truly pay or cause to be paid to my aunt Eliz Palmer spinster for and during the term of her natural life the yearly sum or rent charge of 50s of lawful money of England by two equal payments in the year which I hereby give to her and charge on my said estate so given to my said sister as aforesaid and upon this further condition that she my said sister do bear and pay the charge of my funeral item I give and devise my said freehold lands with the hereditaments and appurtenances thereunto belonging immediately after the decease of my said sister to my cousins Mary Eliz Sarah and Susannah the daughters of my late uncle Thos Porter deceased their heirs and assigns forever all the rest and residue of my estate whatsoever real and personal after all my debts legacies and funeral charges are first paid and satisfied I give devise and bequeath the same to my said cousin Edw Cresner his heirs executors administrators and assigns forever and I do hereby make constitute and appoint him the said Edw Cresner sole executor of this my last will and testament and lastly I do hereby revoke annihilate and make void all former and other wills legacies and bequests by me made and given and do declare these presents to be my last will and testament in witness whereof I have to every sheet of this my last will and testament consisting of four sheets of paper set my hand and to the first and last thereof my seal this 14.6.1706 etc. signed sealed published declared and delivered by the said testator for and as his last will and testament in the presence of (no signatures)
