in the name of god amen I Robt Newman of Earls Colne in the county of Essex yeoman being weak and infirm in body but of a sound and perfect mind and memory thanks be to god do make this my last will and testament in manner following hereby revoking all former wills by me made first and principally I commend my soul into the hands of almighty god my most merciful creator hoping to be saved through the alone merits of jesus christ my most gracious redeemer and my body I desire may be decently buried at the discretion of my executrix hereinafter named and as to that worldly estate wherewith it hath pleased god to bless me I dispose thereof as followeth viz imprimis I give and devise unto Susanna my loving wife for and during he term of her natural life all and singular my freehold messuages lands tenements and hereditaments whatsoever and wheresoever in the said county of Essex and after her decease I give and devise the same premises unto my only son Robt Newman and his heirs forever except a messuage or tenement with the appurtenances in Earls Colne aforesaid in the occupation of Sam Guyon or his assigns which after the death of Margt Newman my late brother Math Newman's widow I give and devise unto my only daughter Susanna Newman and her heirs forever but my will and meaning is that my said son Robt Newman his heirs or assigns shall and do pay unto my said daughter Susanna Newman within one year next after he or they shall enjoy the said freehold messuages lands and tenements the sum of 100li and in case he or they shall refuse or neglect to pay the said 100li to my said daughter as aforesaid then I give and devise unto my said daughter Susanna and her heirs all my messuage cottage lands meadow and tenements with the appurtenances in Earls Colne aforesaid and Colne Engaine in the said county of Essex which I lately purchased of my nephew Jn Newman item I give and devise unto my said son Robt Newman and his heirs forever all and singular my copyhold messuages lands tenements and hereditaments whatsoever and wheresoever of what manor or manors soever the same are holden item I give and bequeath unto my said daughter Susanna Newman the sum of 500li to be paid unto her by my executrix herein after named at her age of 21yr but my will and meaning is that in case she shall marry without the consent of her mother the said Susanna my loving wife then I give unto her but 200li and no more and my will and meaning is that what monies I have out at interest shall be improved by my executrix herein after named and be for and towards the payment of my said daughter's legacy item I do appoint the said Susanna my loving wife guardian of my aforesaid two children until they shall respectively attain their several ages of 21yr item in case my said two children Robt and Susanna shall both happen to die without issue of their bodies under the age of 21yr then I give and devise all my aforesaid freehold and copyhold messuages lands tenements and hereditaments whatsoever and wheresoever unto the said Susanna Newman my loving wife and her heirs forever she by her will or otherwise giving and disposing of the same and every of them to and amongst such of my kinsfolks and relations as she shall think fit item all the rest and residue of my goods chattels household stuff bills bonds mortgages debts ready monies and personal estate whatsoever and wheresoever after my debts legacies funeral charges and probate of this my will shall be satisfied paid and discharged I give and bequeath unto the said Susanna my loving wife whom I nominate and appoint sole executrix of this my last will and testament but my will and meaning is that in case the said Susanna my wife shall after my decease marry again then that all the devises bequests and appointments herein before to her made and given shall be void and of none effect except my said two children shall be both dead without issue then in such case all my devises and bequests herein before to her made and to her heirs shall stand and be in force and in case of such marriage in my said children's lifetime or either of them then I give unto her but 100li only item I will that the said Susanna my wife shall have and receive the rents and profits of the messuages lands and tenements herein before given to my said son Robt until he shall attain his age of 21yr for and towards Robt Newman the education and bringing up of my said two children without any account to be given for the same in witness whereof I the said Robt Newman the testator have to this my last will and testament contained in two sheets of paper to each sheet thereof set my hand and seal the 8.1.1731 etc. signed sealed published and declared by the testator in our presence and in his presence attested and subscribed by us these words the sum of 100li being first interlined Frances Fox Thos Fox S Grimston Robt Newman
