a codicil to be annexed to the last will and testament of me Jn Newton of Earls Colne in the county of Essex gent whereas by my will I have devised certain customary lands and tenements called Boomfields and Gosses holden of the several manors of Colne Priory and Earls Colne subject to a rent charge or yearly annuity therein mentioned to my wife Hannah Newton during the term of her natural life unto my grandson Francis Ruffle and the heirs of his body lawfully begotten with several remainders over as by my said will is particularly mentioned limited or appointed now also I give and devise unto my said grandson Francis Ruffle and the heirs of his body lawfully begotten all those my two closes called Wades or otherwise now laid into one containing by estimation 3a3r10p more or less and all the houses outhouses buildings and appurtenances thereunto belonging as the same premises are holden of the manor of Colne Priory by copy of court roll and are situate lying and being near unto the before mentioned lands and tenements called Boomfields and Gosses in the parish of Earls Colne aforesaid subject and chargeable nevertheless and I do hereby charge the said premises called Wades with the payment of 40s yearly and every year unto my said wife Hannah Newton and her assigns during the term of her natural life to be paid her in the same manner as the before mentioned rent charge payable out of Boomfields and Gosses is by my said will directed with power of entry on the said premises on non payment of the said sum of 40s yearly or any part thereof and if my said grandson Francis Ruffle shall die without issue of his body lawfully begotten then and in such case my will and meaning is and I do hereby give and devise declare limit and appoint the said closes called Wades or otherwise with the houses outhouses buildings and appurtenances thereunto belonging to such person and persons and in such manner and form as the before mentioned lands tenements and premises called Boomfields and Gosses are in and by my said will mentioned given or devised also I subject and charge all those my customary or copyhold lands called Broadfield and Andrews with the appurtenances with all such further sum or sums of money ( over and besides what I have before charged the same premises with ) as shall or may accrue unto the executors or administrators of me or my said wife or unto my tenant Wm Partridge his executors or administrators for or by reason of a lease to him granted by me and by my said wife of such part of my customary lands and tenements called Sandhills or otherwise now in his occupation should he or they be anyways molested therein during the term thereby granted with power of entry for he she they or any of them on the said premises and the same to have keep and enjoy until he she or then shall be fully satisfied all charges and expenses which they may be put unto for or on account of the said lease provided nevertheless his executors and administrators do justly fulfil keep and perform all and every the covenants and agreements in the said lease mentioned and expressed to be by him or them performed fulfilled and kept and not otherwise and I do also hereby declare that by my said will in writing contained in four sheets of paper bearing date the 22.8.1757 and this codicil which I will shall be INSERTED to and deemed part thereof do contain my last will and testament in witness whereof I have to this codicil set my hand and seal this 20.12.1758 Jn Newton signed sealed and published by the said Jn Newton as and for a codicil to be INSERTED to and be part of his last will and testament in the presence of us who subscribed our names in his presence Eliz Wale Mary Holgate Rich Wale
