item it is shown by the homage that Robt Churche late of Earls Colne doctor of theology and tenant of this same manor after the last court and before this court by his surrender presented here in court bearing the date 22.12.1615 surrendered into the hands of the lord by the hands of Robt Cobb instead of the bailiff in the presence of Jn Churche Edw Cressner gentleman and Sam Brewer customary tenants of this manor to the use and intention mentioned and declared in the last will and testament of Robt Churche himself bearing the date 29.11.1615 which same said last will here in court produced and by the same it is agreed and clearly shown that the aforesaid Robt Churche gave and bequeathed among other things one tenement with garden called Burtons to the use and behoof of Barth Churche son of the aforesaid Robt his heirs and assigns forever provided always that if the aforesaid Barth dies before his full age of twenty one years then the aforesaid tenement and garden should remain thereof to Mary Churche one of the daughters of the aforesaid Robt her heirs and assigns forever and now to this court in person came the aforesaid Barth Churche and humbly sought admittance to the aforesaid premises according to the form and effect of the last will and testament aforesaid whereof the lord of the manor by his aforesaid steward granted thereof seisin to have and to hold the aforesaid tenement and garden with appurtenances to the aforesaid Barth Churche his heirs and assigns forever according to the form and effect of the aforesaid last will and testament from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents and services thereunto belonging and by right accustomed and he gave to the lord his fine and was admitted thereof tenant and fealty was respited until etc
