item is shown by the homage that Thos Wade before this court and after the last court viz 23.6.1623 surrendered into the hands of the lord by the hands of Wm Cosyn instead of the bailiff in the presence of Jn Parker and Jn Read two customary tenants of this manor the same testifying according to the custom of the same said manor all that his customary tenement with appurtenances and all land pertaining to the same tenement late in the tenure or occupation of Edw Grigges situated and being in Earls Colne commonly called by the name of a parcel of Seven Acres to the use and behoof of Robt Davye his heirs and assigns forever upon this condition however that if the aforesaid Robt Davye his executors administrators or assigns should pay or cause to be paid to the aforesaid Thos Wade his executors administrators or assigns the sum of 90li of good and legal money of England in or upon the feast day of michaelmas next following this present date in the porch of the parish church of the aforesaid Earls Colne that then this present surrender should stand in its full force and effect otherwise it should be void and of no force or effect in law to whom the same said Robt Davye present here in court the lord by his aforesaid steward granted and delivered thereof seisin by the rod to have to him his heirs and assigns forever upon the aforesaid condition to hold from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents customs and services thereunto belonging and by right accustomed and he paid fine and fealty and was admitted etc
