it is shown by the homage that Jn Church gentleman brother of Barth Church gentleman deceased out of court namely on 13.5.last surrendered into the hands of the lord by the hands of Simon Ive instead of the bailiff in the presence of Jn Hawkesbee clerk and Israel Ennewes two customary tenants the same testifying according to the custom of the aforesaid manor one parcel of a garden at some time of Robt Pierson gentleman containing in length 6rod4ft and in breadth 9ft lying in Colne St viz between the remainder of the aforesaid garden of the said Robt Pierson called Grapnells on one part towards the west and a parcel of a garden late parcel of the said garden called Grapnells late of Geo Beeston and afterwards of Barth Church on the other part towards the east one head thereof abutting upon the kings highway called Colne St towards the south the other head thereof abutting upon lands late of Barth Church deceased towards the north to the use and behoof of Sam Burton of Earls Colne his heirs and assigns to whom the same said Sam Burton present here in court the lord by his aforesaid steward granted and delivered thereof seisin by the rod to have to hold to himself the aforesaid Sam his heirs and assigns forever from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents customs and services thereunto belonging and by right accustomed and he made fine and fealty and was admitted etc
