whereas at a court here held 23.6.1613 Agnes Byrd and Rich Byrd were admitted tenants of the lord to one garden called Judds and to one parcel of garden containing by estimation in length 6rod and in breadth 4rod lying between a garden called Prudds on one part and a tenement late of the Priory convent of Colne on the other part as by the metes and bounds etc by the surrender of Wm Rayner and Joan his wife to the use and behoof of Agnes Byrd widow for the term of the natural life of Agnes herself the remainder thereof after her decease to Rich son of Agnes herself and the heirs of Rich himself legitimately procreated and in default of such issue the remainder thereof to Hen Byrd the other son of the said Agnes and the heirs of the body of the said Hen legitimately procreated and in default of such issue the remainder thereof to Mary then and now wife of Jn Lucas daughter of the said Agnes and the heirs of the said Mary forever and now at this court it is shown by the homage that the aforesaid Rich Byrd and Hen before this court died without heirs of their bodies legitimately procreated and that the aforesaid premises should after the death of the said Agnes at this time being alive remain to the said Jn and Mary as the right of Mary herself by virtue of the above mentioned surrender and the heirs of the said Mary forever who the same said Mary present here in court sought admittance to the aforesaid remainder according to the above mentioned surrender to whom the lord by his steward granted thereof seisin to her to have to her and her heirs to hold from the lord by the rod at the will of the lord according to the custom of the manor by the rents services and customs thereunto belonging and by right accustomed and she gave to the lord her fine as is shown in the margin     and was admitted thereof tenant and afterwards in this same court and the court sitting came the aforesaid Jn Lucas and Mary his wife in person and Mary herself solely and secretly examined by the aforesaid steward as is the custom and they surrendered into the hands of the lord by the hands of his aforesaid steward their aforesaid remainder of and in the aforesaid garden called Judds and in the aforesaid parcel of garden to the use and behoof of the said Jn Lucas and Mary his wife for the term of their lives and to the longer liver and after their decease to the use and behoof of Eliz Lucas second daughter of the said Jn and Mary and the heirs of the body of Eliz herself legitimately procreated and in default of such issue then to the use and behoof of Mary first born daughter of the said Jn and Mary and the heirs of the body of the said Mary legitimately procreated and in default of such issue to the rightful heirs of the said Jn and Mary forever who the same said Jn and Mary present here in court and the aforesaid Eliz by Jn her father sought admittance to the aforesaid remainder according to the above mentioned surrender to whom the lord by his aforesaid steward granted to them seisin thereof to have to them according to the above mentioned surrender to hold from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and the aforesaid Jn Mary his wife and Eliz gave to the lord their fine as is shown in the margin     and the aforesaid Jn made fealty to the lord and they were admitted thereof tenants
