and furthermore at this court it is shown by the homage that Barth Church gentleman customary tenant of this manor after the last court and before this court viz 29.4.1629 surrendered into the hands of the lord by the hands of Simon Ive instead of the bailiff in the presence of Jn Hawksby clerk and Rich Kempe two customary tenants of the aforesaid manor the same testifying according to the custom of the aforesaid manor among other things one customary tenement with garden adjoining called Burtons alias Britons with appurtenances held of the aforesaid manor by name all his lands tenements and hereditaments customarily held of the aforesaid manor to the use and intention of his last will and testament and afterwards viz 11.1.1630 the aforesaid Barth Church made his last will and testament in writing signed and approved under the signature of the ordinary for this area it was produced and shown here in court by which it was agreed by the court that the aforesaid Barth by his aforesaid testament willed and bequeathed the aforesaid tenement with garden adjoining called Burtons alias Britons to a certain Rose Church his mother and her heirs forever and afterwards and before this court the aforesaid Barth Church died thus seised thereof upon which came the aforesaid Rose Church here into court and humbly sought admittance to whom the lord by his aforesaid steward granted and delivered thereof seisin by the rod to have the aforesaid tenement with garden adjoining called Burtons alias Britons to the aforesaid Rose Church her heirs and assigns forever to hold from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and she gave to the lord her fine and made fealty to the lord and was admitted
