whereas at a court here held 5.12.1616 Hen Abbott was admitted tenant of the lord for himself and his heirs to one customary tenement and garden adjoining and to two crofts of land containing by estimation 2a more or less situated in Church St in the aforesaid Earls Colne as by a roll of the aforesaid court it appears and whereas at the last court here held 3.1.1637 it was shown by the homage that the aforesaid Hen Abbott senior after the last court and before the said court surrendered into the hands of the lord of the aforesaid manor the aforesaid messuage and other premises with appurtenances to the use and intention of his last will and testament as by a roll of the aforesaid court it appears now at this court it is shown by the homage that after the said court and before this court the said Hen Abbott died thereof thus seised upon which came here into court Robt Abbott second son of the said Hen Abbott senior and produced here in court the last will and testament of the said Hen Abbott his father in writing bearing the date 6.11.1625 the tenor of which concerning the premises in these following words I give and bequeath unto Robt Abbott my son and to his heirs and assigns forever all that my customary tenement situate and being in Church St in Earls Colne with a garden plat and two crofts of land thereunto belonging containing by estimation 3a more or less with all and singular the appurtenances as they now are in the tenure and occupation of Hen Abbott my son in Earls Colne aforesaid provided always and upon condition that my said son Robt his heirs and assigns shall pay or cause to be paid to Thomasine my well beloved wife one annuity or yearly rent of 4li of good and lawful english money so long as she remain a widow and no longer upon which the aforesaid Robt Abbott humbly sought admittance to whom the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have the aforesaid tenement garden and croft of land with appurtenances to the aforesaid Robt Abbott his heirs and assigns forever upon the aforesaid condition to hold from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and he gave to the lord his fine and made fealty
